HomeMy WebLinkAboutOrdinance-1980-0373ORDINANCE NO. 373 INTRODUCED BY COUNCILMEMBER Cavarra Series of 1979 TITLE: AN ORDINANCE AMENDING SECTION 15-5(m) CONCERNING LITTERING AND ADDING SECTION 15-5(u) CONCERNING GLASS CONTAINEP.S, OF CHAPTER 15, ARTICLE II, OF THE CODE OF THE CITY OF WHEAT RIDGE, COLORADO, CONCERNING PARKS AND RECREATION RULES AND REGULATIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: Section 1. Section 15-5(m) entitled "Littering" of Chapter 15, Article II of the Code of the City of Wheat Ridge, Colorado, is hereby amended to read as follows: (m) Littering. It shall be unlawful to dump, deposit, discard, throw, or leave any bottles, cans, broken pieces of glass, papers, boxes, dirt, rubbish, waste, garbage, refuse or trash upon or within any park, lake, or other recreational area or facility of the city. It shall be unlawful for any person utilizing the facility of any park, lake, or recreational area or facility of the city to leave such area or facility without first having completely extinguished fires, or before all trash, waste, or garbage as defined within is placed in the disposal receptables where provided. If no receptacle is provided, such persons shall remove all trash, waste, or garbage from the park, lake, or other recreational area or facility and properly dispose of it elsewhere. The act of dumping, depositing, discarding, throwing, or leaving shall be sufficient in and of itself to constitute a completed act of littering. It shall not be necessary for the person dumping, depositing, discarding, throwing, or leaving to depart from the immediate vicinity in order to constitute a prima facie violation of this section. Section 2. Section 15-5 of Chapter 15, Article II of the Code of the City of Wheat Ridge, Colorado is hereby amended by the addition of Subsection (u) as follows: (u) Glass containers. It shall be unlawful for any person to bring, or to have in his possession, any glass beverage bottle, in any park, lake, or other recreational area or facility of the city. Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge; that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to these objectives. Section 4. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances.
