HomeMy WebLinkAboutOrdinance-1980-0374ORDINANCE NO. 374 INTRODUCED BY COUNCILMEMBER Ore Series of 1979 TITLE: AN ORDINANCE REPEALING AND REENACTING SECTION 15-8 OF CHAPTER 15, ARTICLE II OF THE CODE OF THE CITY OF WHEAT RIDGE, COLORADO, CONCERNING PARKS AND RECREATION RULES AND REGULATIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: Section 1. Section 15-8 of Chapter 15, Article II of the Code of the City of Wheat Ridge, Colorado, is hereby repealed in its entirety and reenacted as follows: Sec. 15-8. Water Areas. (a) Swimming. Swimming is only allowed as part of a scheduled and supervised recreational program, sponsored by the department or authorized by department permit. Any allowed swimming activity shall be subject to any specific rules and regulations which may be issued and enforced by the director or his agent. (b) Boating. (1) Use restricted. It shall be unlawful to use any boat, raft, or floating device of any kind, type, or description upon any waters in the park and recreation area of the City of Wheat Ridge except in conformity with the provisions of this subsection (b). (2) Safety inspections. It shall be unlawful for anyone to use any boat, raft, or floating device upon the waters of the park and recreation area without a current safety inspection and a valid safety inspection sticker. Safety inspections and inspection stickers may be obtained at the Prospect Park Rangers Office each Saturday during the official boating season between the hours of 10:00 a.m. and 12:00 Noon and on other days and times as, and if, announced by the Director of Parks and Recreation. (3) Safety inspection requirements. In order to obtain a safety inspection sticker from the Department of Parks and Recreation, the following requirements shall be met: a. The boat shall be non-motorized, propelled solely by means of oars and paddles or by the use of cloth sails. Any boat which, in addition to having the ability to be propelled by one of the above-mentioned means, has a motor driven means of propulsion, shall be classified as motorized. The use of motorized boats upon the waters of the City lake is not permitted. b. The boat shall be in a sea-worthy condition, as defined and determined by the Department of Parks and Recreation. ORDINANCE NO. 374 PAGE TWO C. The boat shall have one personal floatation device of a type currently approved for use by the United States Coast guard for each person occupying the boat. d. The boat shall have at least one oar or paddle which shall be carried on board when the boat is in use. e. The boat shall have a completed registration, if applicable. (4) Boating season and hours. Open boating shall be permitted from 7:00 a.m. until one-half hour past sunset during the period from April 1 through October 31 annually. (5) Age. Boat operators shall be at least fifteen (15) years of age or accompanied by and be under close super- vision of an adult. (6) Buoys and islands. Boaters shall observe and remain clear of all areas marked by buoys. No person shall dock any boat upon, physically no upon, or swim from any island in any lake within the city. (7) Swimming. Swimming or wading, except as provided for within subsection 15-8(a) above, is permitted only in connection with launching or recovering a boat. Swimming from a boat is expressly prohibited, unless engaged in a legitimate rescue attempt. (8) Docks. The dock area is for loading and unloading activity-only and boats may not be tied to docks any longer than necessary to accomplish this activity. (g ) Group boating activities. Any group boating activity, organized race, regatta, or any other type of organized boating activity shall be approved in advance in writing by the Director of Parks and Recreation or his designated representative. (10) Boats shall follow a counter-clockwise sailing traffic pattern whenever possible. (11) Intoxicated persons and alcoholic beverages of any type shall not be permitted upon the lake, dock areas, or launch ramp area. (12) Glass containers and littering. Glass containers are prohibited upon the lake, dock areas, or launch ramp area. Discarding food, objects, or waste of any kind or type into the lake, upon the dock areas, or in the launch ramp area is prohibited. (13) Park rangers. Park rangers may order inexperienced opera- tors from the lake when, in the park ranger(s)' judgment such operators constitute a safety hazard to themselves or other operators. Park rangers may also order from the lake persons or crafts operating in a reckless or careless manner or in disregard of or in violation of Department of Parks and. Recreation rules and regulations. Park rangers shall have the authority to close the lake because of inclement weather or any other unsafe condition. ORDINANCE NO. 374 PAGE THREE (c) Fishing. Fishing shall be allowed from the shoreline only, excluding dock areas and boat launch areas. Fishing from boats is prohibited. Fishing shall be in accordance with state law, with the exception that any bass taken under ten (10) inches shall be immediately returned to the water. Section 2. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge; that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational :relation to these objectives. Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 4. This ordinance shall take effect after final publication. 15 days INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on this 10th day of December 1979; ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for January 2 1980, at 7:30 o'clock P.m., at Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
