TITLE: Ali ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
RESTRICTED COMMERCIAL (RC) TO COMMERCIAL-ONE (C-1) FOR LAND
LOCATED AT APPROXIMATELY 3901 WADSWORTH, CITY OF WHEAT RIDGE,
COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, T?IAT :
Section 1. Upon application of Benedict C. and Lillian D. Pisciotta
for approval of rezoning in Wheat Ridge, Colorado, Case No. WZ-79-46
and based upon recommendation for approval from the Wheat Ridge
Planning Commission and pursuant to findings made based on testimony
and evidence presented at public hearing before the Wheat Ridge City
Council, Wheat Ridge maps are hereby amended to exclude from the
Restricted Commercial (RC) District and to include in the Commercial-
One (C-1) zone district the following described land:
A parcel of land in the Northeast 1/4 of the Southeast 1/4
of the Southwest 1/4 of Section 23, Township 3 South, Range 69
West of the 6th Principal Meridian, County of Jefferson, State
of Colorado, described as follows: Beginning at the South-
east corner of said Southwest 1/4 of Section 23; thence
i1o020100"E 686.10 feet to a point 25.00 feet North of the
Southeast corner of said Northeast 1/4 of the Southeast 1/4
of the Southwest 1/4 of Section 23; thence N89049'50"W,
40.00 feet to the TRUE POINT OF BEGINNING; thence continuing
on the last described course N89049'50"W, 140.00 feet to a
point 180.00 feet Westerly of the East line of the said North-
east 1/4 of the Southeast 1/4 of the Southwest 1/4 of
Section 23; thence NO020'00"E, 108.00 feet, parallel to the
East line of said Northeast 1/4 of the Southeast 1/4 of the
Southwest 1/4 of Section 23; thence S89049'50"E, 140.00 feet
parallel to the South line of the said Northeast 1/4 o the
Southeast 1/4 of the Southwest 1/4 of Section '?3; thence
SOo20'00"1V, 108.00 feet to the Point of Beginning,
containing 0.347 acres, more or less.
Section 2. Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the general
,nlice Dower of the City of Wheat Ridge, that it is promulgated
or the health, safety, and welfare of the public, and that this
ordinance is necessary for the preservation of health and safety
and for the protection of public convenience and welfare. The City
Council further determines that the ordinance bears a rational
relation to the proper legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after tinal
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of _8
to _ 0 on this 21st day of January , 1980; ordered
published in full in a newspaper of general circulation in the City
of Wheat Ridge and Public Hearing and consideration on final
passage set for Mondav, February 11, , 1980, at
7:30 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue,
Wheat Ridge, Colorado.

by a vote of _Z to Ithis day ofFebruary 1980.
