TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
AGRICULTURE-ONE (A-1) TO PLANNED COMMERCIAL DEVELOPMENT
(PCD) AND APPROVAL OF AN OUTLINE DEVELOPMENT PLAN FOR LA14D
LOCATED ON YOUNGFIELD STREET AND APPROXIMATELY 1500 FEET
EAST AND BETWEEN CLEAR CREEK AND APPROXIMATELY 2000 FEET
SOUTH, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF
COLORADO.
Section 1. Upon application of Kunz and Barber for approval of
rezoning in Wheat Ridge, Colorado, Case No. WZ-79-45 and based upon
recommendation for approval from the Wheat Ridge Planning Commission
and pursuant to findings made based on testimony and evidence presented
at public hearing before the Wheat Ridge City Council, Wheat Ridge
maps are hereby amended to exclude from the Agriculture-One (A-1)
District and to include in the Planned Commercial Development (PCD)
zone district the following described land;
Beginning at a point which lies 1,306.06 feet, S73022'02"W,
(S89o33'W, 1,256.16feet, SO044'16"E, 364.01 feet) from the
North 1/4 corner of Section 29, Township 3 South, Range 69 West
of the 6th P.M., which point is also the Northwest corner of
Ridge Subdivision, as filed in the Records of Jefferson County,
Colorado, and which point lies N890331E, 60.0 feet, SO044'16"E,
364.01 feet from the Northwest corner of the Northeast 164 of
the Northwest 1/4 of said Section 29, thence running N64 25'23"E,
a distance of 495.87 feet, along the North line of Ridge Sub-
division, hence NOo44'26"W, a distance of 1,772.95 feet,
thence S75 06142"W, a distance of 462.77 feet to a point on
the East right-of-way line of Youngfield Street, thence
SOo44'16"E, a distance of 1,873.25 feet to the Point of
Beginning. Together with a 50 foot nonexclusive easement over
and across tract as described hereinabove for ingress, egress
and utility lines, said 50 foot easement to run parallel with
and measured perpendicular to the Northerly line of said tract
and to be the Southerly 50 feet located within the Northerly
150 feet of said tract, also together with a 50 foot non-
exclusive easement over and across the Northerly 55.10 feet of
the South 80.10 feet of the tract as described hereinabove for
ingress, egress and utility lines, said easement to be parallel
to the Southerly line of said tract with the 50 foot dimension
being measured perpendicular to the South line of said tract.
This parcel contains approximately 18.83 acres.
Section 2. Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the general
police power of the City of Wheat Ridge, that it is promulgated for
the health, safety, and welfare of the public, and that this ordinance
is necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council further
determines that the ordinance bears a rational relation to the proper
legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part
of this ordinance or the application thereof to any person or circum-
stances shall for any reason be adjudged by a court of competent
jurisdiction invalid, such judgment shall not affect, impair or
invalidate the remainder of this ordinance or its application to
other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final
publication.

INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on this
25th day of February, 1980; ordered published in full in a newspaper of general
circulation in the Citv of Wheat Ridge, and Public Hearing and consideration on
final passage set for March 17 , 1980, at 7:30 o'clock p.m. in the Council
Chambers, 7500 ]lest 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED, AND ORDERED PUBLISHED on second and final reading by a vote of 5
to 2 , this 17th day of March , 1980.
