ORDINANCE NO. 392

TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
RESIDENTIAL-THREE (R-3) TO RESTRICTED COMMERCIAL-ONE (RC-1)
FOR LAND LOCATED AT APPROXIMATELY 3825 AND 3827 SHERIDAN
BOULEVARD, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE
OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORAO,
THAT:
Section 1. Upon application of Zeferino and Prudence Halguin and
Charles and Linda Ellis for approval of rezoning in Wheat Ridge,
Colorado, Case No. WZ-79-42 and based upon recommendation for approval
from the Wheat Ridge Planning Commission and pursuant to findings
made based on testimony and evidence presented at public hearing be-
fore the Wheat Ridge City Council, Wheat Ridge maps are hereby amended
to exclude from the Residential-Three District and to include in the
Restricted Commercial-One District the following described land:
Commencing at the Southeast corner of Section 24, Township 3
South, Range 69 West of the Sixth Principal Meridian, in the
City of Wheat Ridge, Jefferson County, Colorado, which corner
lies in the intersection of West 838th Avenue with Sheridan
Boulevard; running thence North00 00'30"East along the East
line of said Section twenty rods more or less to a point thirty
feet East of the Southeast corner of Lot 2, Riethmann's Minor
Subdivision; running thence North89043'45"West thirty feet to
said Southeast corner at the true point of Beginning; thence
continuing North89043185"West 161.00 feet to its Southwest
corner; thence North00 00130"East along the West line of
Lots 1 and 2 of Riethmann's Minor Subdivision 104.0 feetd to the
Northwest corner of the aforesaid Lot l; thence South89 43'45"East
161.00 feet to the West line of Sheridan Boulevard; thence
SouthODo00'30"West along said West line 104.0 feet more or less
to the true point of Beginning, said tract containing 0.384
acre or 0.156 Hectare more or less net.
Section 2. Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the general
police power of the City of Wheat Ridge, that it is promulgated for
the health, safety, and welfare of the public, and that this ordinance
is necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council further
determines that the ordinance bears a rational relation to the proper
legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or
oart of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its application
to other persons or circumstances.
Section 4. This ordinance shall take effect _ 14 days after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to
0 on this 17th day of March , 1980; ordered published in
full in a newspaper of general circulation in the City of Wheat Ridge

and Public Hearing and consideration on final passage set for
Monday, April 14 , 1980, at 7:30 o'clock p.m., in the Council
Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED RUBLISHED on second and final reading by
a vote of 7 to I , this 14th day of _ April 1980.
