HomeMy WebLinkAboutOrdinance-1980-0399INTRODUCED BY COUNCILMU?BER MERKL ORDINANCE NO. 399 Series of 1980 TITLE: AN ORDINANCE REPEALING AND REENACTING SECTION 6-1 AND SECTION 6-2 OF THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE, COLORADO, ADOPTING BY REFERENCE THE NATIONAL ELECTRICAL CODE, 1978 EDITION, COPYRIGHT 1978, PROVIDING FOR CERTAIN AMENDMENTS THERETO AND PROVIDING PENALTIES FOR VIOLATION THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: Section 1. Section 6-1 of the Code of Laws of the City of Wheat Ridge, Colorado, is hereby repealed and reenacted as follows: "The National Electrical Code, 1978 Edition, copyright by the National Fire Protection Association, is hereby adopted by reference thereto and incorporated into this chapter as though fully set forth herein as the Electrical Code of the City of Wheat Ridge. Three (3) copies of said National Electrical Code shall be filed in the office of the City Clerk and may be inspected during regular business hours. Except as otherwise provided in this chapter, such Code is adopted in full, including the index and appendix contained therein." Section 2. Section 6-2 of the Code of Laws of the City of Wheat Ridge, Colorado, is hereby repealed and reenacted as follows: (a) Section 310-1 is amended by adding a new paragraph which reads: "Aluminum conductors under size 8 are not allowed." (b) Section 336-3, "Use," paragraph (c), "Uses not permissible for either NM or NMC Non-metallic-sheathed cable" is amended by changing the entire paragraph to read: "These types shall not be used as: (1) service entrance cable, (2) in any group A, B, E, H or I occupancy (as defined in the Uniform Building Code, 1979 Edition, Chapter 5, Table 5(A), (3) in any hazardous location, (4) embedded in poured cement, concrete or aggregate, (5) and as secondary feeder from the main service to individual panelboards in group R-1 occupancies." Section 3. Purpose. The purpose of this Code is to provide minimum standards to insure the health, safety and welfare of the general public by regulating and controlling the design, construction, quality of materials, installation and all related uses of electri- cal wiring and equipment within the City as provided herein. Section 4. Violation and Penalties. It shall be unlawful for any person, firm or corporation to wreck, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use occupy or maintain any building or structure in the City, or cause or permit the same to be done, contrary to, or in violation of any of the provisions of the Uniform Building Code. Section 5. Severability. If any part or parts of this ordinance ORDINANCE NO. 399 are for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each part or parts thereof, irrespective of the fact that any one part or parts be declared invalid. Section 6. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the police power of the City of Wheat Ridge; that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to these objectives. Section 7. This ordinance shall take effect 14 days after final publication. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on this 17th day of March , 1980; ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for Monday, April 14, , 1980, at 7:30 o'clock p.m., at Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
