HomeMy WebLinkAbout11/02/1972 MINUTES November 2, 1972 The one hundred and eightieth regular meeting of the Wheat Ridge City Council was called to order at 7 40 p.m. by Mayor Albert E. Anderson at 7390 West 3B Avenue. Aldermen present were Dr. Paul Abramson, Joseph Donaldson, Robert Howard, Calvin Hulsey, Ray Pepe. Alderman Jack Bramble was absent. An item not on the Agenda was brought up made the following Motion "I move that of BOO tons of chip at $2.54 per ton and per ton for a total cost of $3,312.00." Alderman Abramson by Alderman Donaldson who Council approve the purchase BO tons of salt at $16.00 Motion was seconded by Comments from George Hunter, Street Supervisor indicated that 500 tons of gravel were used in the present snow storm and that 390 tons on hand at the present time could be depleted in the next storm. Question was called on the Motion to approve the purchase and Motion passed 4-1. Alderman Howard voted "nay" Glenn items 1 2. Acquisition of a roller. continuance of two The items were Walter Johnson, Director of Personnel presented to Council several pages of recommendations for amendments to Ordinance No. 117. Depart- ment recommendations were also included. Alderman Howard stated he would like to have Council sit down with the Personnel Committee for discussion on the matters so Council can understand the Personnel Committee's viewpoints Mr. Johnson stated there was sufficient time for such a meeting before time would expire for passage of the Ordinance. Alderman Abramson recommended COUnCi~^throUgh the items one at a time and decide on each one. Ordinance No. 117 was brought up for second consideration and the ti tle read. Motion was made by Alderman Abramson, seconded by Alderman Donaldson and passed 5-0 "that the Clerk dispense with reading the balmce of the Ordinance " Motion by Alderman Howard "I move the matter be tabled until Council can meet with the Personnel Committee and with Mr. Johnson to go over the matter because there are questions that need to be answered." Motion was seconded by Alderman Donaldson and passed 3-2. Aldermen Hulsey and Abramson voted "nay." Alderman Howard was asked if he intended the Motion to include action on the Ordinance or just the amendments. He answered "all of it." Attorney Fox ruled the Motion as stated applied only to the amendments and that the Ordinance was still on the floor. Both said they would vote MINUTES - Continued - November 2, 1972 -2- Aldermen Abramson Soid the reason for the Motion was that the impor- tance of the matter would require Council to act quickly on a meeting and on the Ordinance. Question was called and Motion to table the Ordinance was defeated 3-2. Motion by Alderman Pepe "I move that Ordinance No. 117, introduced by Alderman Donaldson be adpoted on second reading and be ordered published and posted." Motion was seconded by Alderman Donaldson and passed 3-2. Attorney Fox ruled that the Ordinance had not passed into law because the appropriation of money requires a "majority of the elected members of Council, not just a majority of those present. He said the Ordinance could be brought up a second time for amendments and that an emergency clause could be added at the same time. Louise Turner of the Animal Control Department requested improvements in the present animal control operation and submitted to Council in writing the request that equipment and authority perviously allowed to the department and removed by Memos and lor orders from Mayor Anderson be returned. Namely, that a 22 rifle be mounted in the truck for emergency use ~f Deeded when an officer is not available, that the Warden be giveH~tAe authority to write tickets, that the department be allowed a radio for direct contact with the Warden during the 40 hour work week and a fourth request which was mentioned but not dis- cussed that men on emergency night call be allowed to keep the animal truck at home. Considerable discussion took place and Attorney Fox in answer to questions stated that the solution to the use of a gun and writing tickets was to have the Warden sworn as a peace officer and that the question would be who would do it, that the power is given to the Mayor and no one else including a City Administrator in a statutory city, that the Council cannot give directions to the Mayor but could take a suggestion approach. Mayor Anderson indicated he had removed the gun because he felt it was in violation of the Penal Code, and that he was not willing to swear the Animal Warden as a peace officer which would allow him to write tickets unless he (the Warden) would be assigned to the Police Department and that he had not approved replacement of the radio which was removed from the animal control office because he did not want $300.00 spent on radio equipment that might not have a use when changes are made in City Hall. Motion by Alderman Abramson "I move that the Council urge the Mayor to take all steps possible to end the duplication of effort going on currently in the Animal Control Office at his earliest convenience." Motion was seconded by Alderman Hulsey and passed 5-0. A copy of the request from the Department and a detailed report of the questions asked and the comments made, is filed in the Animal Control file under "Authority of the Animal Warden." Attorney Fox requested Resolution No. 191 (pertaining to condemnation of greenbelt property) was read. Motion by Alderman Pepe "I move Resolution No. 191 be approved." Motion was seconded by Alderman Abramson and passed 5-0. Resolution No. 192 (pertaining to condemnation of greenbelt property) was read. Motion by Alderman Abra!U.S{]n: "r move that Resolution No. 192 be approved." Motion was seconded by ~ldermqn Donaldson and passed 5-0.
