TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A ZONING MAP CORRECTION
FROM RESIDENTIAL ONE (R-1) TO RESIDENTIAL ONE-A (R-IA) ON PROPERTY
INVOLVED IN A ZONING DISCREPANCY CASE NO. WZ-78-105D LOCATED AT
12365 WEST 38th AVENUE, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON,
STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF 14HEAT RIDGE, COLORADO,
THAT:
Section 1. Upon application by the City of Wheat Ridge for approval of
a zoning map correction from Residential One (R-1) to Residential One-A
(R-lA) in Zoning Discrepancy Case No. WZ-78-105D and pursuant to findings
made based upon testimony and evidence presented at public hearing before
the Wheat Ridge City Council, Wheat Ridge zoning maps are hereby amended
to exclude from the Residential One District and to include in the
Residential One-A (R-IA) District the following described land:
Beginning at the northeast corner of the NW 1/4 NE 1/4 of Section 29,
T3S, R69W of the 6th P.M., thence SO°29' E along the east line of the
NW 1/4 NE 1/4 of said Section 29 a distance of 215.60 feet to the
center of West 38th Avenue (formerly known as Prospect Avenue), thence
S76°41' W along the center of West 38th Avenue a distance of 276.15
feet, said point being at the intersection of a north-south line
through a concrete post at the north side of West 38th Avenue and
through a second concrete post approximately 797 feet north of the
first post, all as described in Book 673 at Page 300 of the Official
Records of the County of Jefferson, State of Colorado; thence
NO°07.6' W along the line through said posts a distance of 539.36
feet; thence S89°36.7' W parallel to the south line of the SE 1/4
of Section 20, T3S, R69W a distance of 306.35 feet to a point on the
westerly line of that tract described in Book 475 at Page 523 of
said County Records; thence SO°05.5' E along the westerly line of that
tract described in said Book 475 at Page 523 a distance of 290 feet to
the true point of beginning; thence N39°36.7' E a distance of 137.35
feet; thence SO°05.5' E a distance of 288.28 feet to the center of
West 38th Avenue; thence S76°41' W along the center of West 38th
Avenue a distance of 141.09 feet; thence NO°05.5' W a distance of
319.85 feet to the true point of beginning.
Section 2. Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the general
police power of the City of Wheat Ridge, that it is promulgated for
the health, safety, and welfare of the public, and that this ordinance
is necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council further
determines that the ordinance bears a rational relation to the proper
legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part
of this ordinance or the application thereof to any person or circumstances
shall for any reason be adjudged by a court of competent jurisdiction
invalid, such judgment shall not affect, impair or invalidate the remainder
of this ordinance or its application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8
to 0 on this 9th day of June , 1980; ordered
published in full in a newspaper of general circulation in the City of
Wheat Ridge and Public Hearing and consideration on final passage set
for July 14 , 1980, at 7:30 o'clock p.m., in the
Council Chambers, 7500 ?Jest 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a
vote of 8 to 0 , this 14th day of July
1980.
