HomeMy WebLinkAboutOrdinance-1980-0412INTRODUCED BY COUNCILMEMBER PIerkl ORDINANCE NO. 412 SERIES OF 1980 TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A ZONING MAP CORREC- TION FROM PLANNED RESIDENTIAL DEVELOPMENT (PRD) TO RESTRICTED COMMERCIAL (RC) FOR LAND LOCATED AT APPROXIMATELY 11465 WEST 44TH AVENUE, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Upon application of the City of Wheat Ridge for approval of a zoning map correction in Wheat Ridge, Colorado, Case No. WZ-79-21D and based upon recommendation for approval from the Wheat Ridge Planning Commission and pursuant to findings made based on testimony and evidence presented at public hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby corrected to exclude from the Planned Residential Development District and to include in the Restricted Commercial District the following described land: That part of the Northwest one-quarter of Section 21, Township 3 South, Range 69 West, described as follows: Beginning at a point on the West line of said Northwest one-quarter which point is 1320 feet South of the Northwest corner thereof; thence East at right angles 640 feet, more or less, to the West right-of-way line of Robb Street; thence South 661.5 feet, more or less, to the Northerly right-of-way line of W. 44th Avenue; thence Westerly, along the Northerly right- of-way line of W. 44th Avenue, 640 feet, more or less, to the West line of said Northwest one-quarter; thence North along the west line of said Northwest one-quarter, 660 feet more or less, to the point of beginning, EXCEPT the West 3-1/3 acres thereof; EXCEPT the South 250 feet of the East 150 feet thereof; and EXCEPT the North 411.5 feet thereof, together with 6-2/3 shares of Water Stock in the Lane Ditch Company in connection with the above described property, County of Jefferson, State of Colorado. Section 2. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object to be attained. Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 4. This ordinance shall take effect 15 days after final publication. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to on this 28th day of July , 1980; ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for ^unust 18 , 1980, at 7:30 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
