ORDINANCE NO. 414
SERIES OF 1980
TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A ZONING MAP
CORRECTION FROM AGRICULTURAL ONE (A-1) TO RESIDENTIAL
ONE A (R-lA) FOR LAND LOCATED AT APPROXIMATELY 3900 WEST
35TH AVENUE, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON,
STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO,
THAT:
Section 1. Upon application of the City of Wheat Ridge for approval
of a zoning map correction in Wheat Ridge, Colorado, Case WZ-80-13D
and based upon recommendation for approval from the Wheat Ridge
Planning Commission and pursuant to findings made based on testimony
and evidence presented at public hearing before the Wheat Ridge Citv
Council, Wheat Ridge maps are hereby corrected to exclude from the
Agricultural One District and to include in the Residential One A
District the following described land:
The southerly 180 feet of Wide Horizons, described as: Beginning
at the Southwest corner of the NW 1/4 NE 114 of said Section 27,
thence easterly along the South boundary of Said NW 1/4 NE 1/4
331 feet to the TRUE POINT OF BEGINNING, thence continuing
easterly along the South boundary of said NW 1/4 NE 1/4 664.1
feet, more or less, to the center line of Everett Street, thence
northerly along the center line of Everett Street 205 feet,
thence westerly along a line parallel to the said South boundary
of said NW 1/4 NE 1/4 664.1 feet, thence southerly along a line
parallel to the East boundary of said NW 1/4 NE 114 205 feet, more
or less, to the True Point of Beginning, subject to the right-of-
way for West 35th Avenue along the South side thereof and subject
to the right-of-way for Everett Street along the East side thereof.
Section 2. Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the general
police power of the City of Wheat Ridge, that it is promulgated for
the health, safety, and welfare of the public, and that this ordinance
is necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council further
determines that the ordinance bears a rational. relation to the proper
legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final
publication.
INTRODUCED, READ AND ADOPTED on first reading by a vote of 8
to 0 on this 28th day of July , 1980;
ordered published in full in a newspaper of general circulation in the
City of Wheat Ridge and Public Hearing and consideration on final passage
set for August 18 , 1980, at 7:30 o'clock p.m., in the Council
Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a
vote of 7 to 0 , this 18th day of August , 1980.
