HomeMy WebLinkAboutOrdinance-1980-0422INTRODUCED BY COUNCILMEMBER BOWMAN ORDINANCE NO. 422 SERIES OF 1980 TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A ZONING MAP CORRECTION FROM RESTRICTED COMMERCIAL (R-C) TO RESTRICTED COMMERCIAL ONE (R-Cl) FOR LAND LOCATED AT APPROXIMATELY 3660 WADSWORTH BOULEVARD, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO. (WZ-76-11) BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT- Section 1. Upon application of the City of Wheat Ridge for approval of a zoning map correction in Wheat Ridge, Colorado, Case No. WZ-80-18D and based upon recommen- dation for approval from the Wheat Ridge Planning Commission and pursuant to findings made based on testimony and evidence presented at public hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby corrected to exclude from the Restricted Commercial (R-C) District and to include in the Restricted Commercial One (R-CI) District the following described land. That part of the NW 1/4 NE 1/4 Section 26, Township 3 South Range 69 West, Described as follows: Beginning at a point on the Northwest corner of NW 1/4 of Section 26 (marked by a stone on East line of Wadsworth Blvd.), thence West 45 feet and South 412.2 feet to a point (on line of property of Mrs. Arthur Gunderson), thence East 220.5 feet to Church Property, thence South 120.0 feet to point (on line with property of Alex H. Kahre), thence West 220.5 feet to a point on the East line of Wadsworth Blvd., thence North 120.0 feet along East line of Wadsworth Blvd. to point of beginning. Section 2. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object to be attained. Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 4. This ordinance shall take effect 15 days after final publication. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 7 to 0 on this 29th day of September , 1980; ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for October 20 , 1980, at 7:30 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
