HomeMy WebLinkAboutOrdinance-1980-0426INTRODUCED BY COUNCILMEMBER BOWMAN ORDINANCE NO. 426 SERIES OF 1980 TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A ZONING MAP CORRECTION FOR PARCEL 1 FROM AGRICULTURAL ONE (A-1) AND AGRICULTURAL TWO (A-2) TO AGRICULTURAL ONE (A-1) AND A ZONING MAP CORRECTION FOR PARCEL 2 FROM NO ZONING TO AGRICULTURAL TWO (A-2) FOR LAND LOCATED AT APPROXIMATELY THE INTERSECTION OF VIVIAN STREET (EXT.) AND WEST 41ST AVENUE (EXT.). BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Upon application of the City of Wheat Ridge for approval of a zoning map correction in Wheat Ridge, Colorado, Case No. WZ-80-27D and based upon recommen- dation for approval from the Wheat Ridge Planning Commission and pursuant to findings made based on testimony and evidence presented at public hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby corrected to exclude from Parcel One (1) the Agricultural One (A-1) District and the Agricultural Two (A-2) District and to include in the Agricultural One (A-1) District the following described land: Parcel One That part of the South one-half kS 1/2) of Section 20 and of the Northeast one-quarter of the Northwest one-quarter (NE 1/4 NW 1/4) of Section 29, Township 3 South, Range 69 West of the 6th P.M., described as follows: Beginning at a point on the East right of way line of Youngfield Street, from which point the quarter corner between said Section 20 and 29 bears N73°22'52"E, 1306.06 feet, and which point is also the Northwesterly corner of Ridge Subdivision; thence N64°25'23"E along the northerly line of Ridge Subdivision, 1112.40 feet; thence NO°0'40"E, 180 feet; thence N58°57'43"E, 195 feet; thence S84°26'05"E, 165.78 feet to the West line of a parcel of land described in Book 759 at page 462 of Jefferson County records; thence N0°05'34"W along said West line, 1082.95 feet to the North line of said tract described in Book 759 at page 462; thence S87°58'E along the North line of said tract, 664.32 feet to the West line of the John R. Lee tract as described in Book 202 at Page 328 of said records; thence NO°08'41"W along the West line of said John R. Lee Tract, 200 feet to the South line of Pearl of the Valley Subdivision; thence N86°W, 185.65 feet to the Southeast corner of tract of land conveyed to Harold N. Lee by deed recorded in Book 497 at page 562; thence NO°29'57"W, 357.50 feet to the Northeast corner of said Harold N. Lee tract; thence S89°39'33"W, 560.47 feet 'o the North- South centerline of said Section 20; thence NO°09'29"E along said North- South centerline of Section 20, 194.23 feet to the Northeast corner of tract of land conveyed to Harold N. Lee by deed recorded in Book 451 at page 323; thence S89°25'W along the North line of said Lee tract, 513.7 feet to the Northwest corner thereof; thence SO°32'E, 244.95 feet; thence S72°57'58"W, 145.09 feet; thence S75°46'12"W, 644.96 feet to the East right of way line of Youngfield Street; thence SO°44'16"E along said East right of way line, 334.21 feet to the North line of tract of land described in Book 480 at page 595; thence N89°15'44"E, 169 feet to the Northeast corner of said tract described in Book 480 at page 595; thence SO°44'16"E, 100 feet; thence S78°42'44"W along the Southerly line of said tract described in Book 480 at page 595, 172.79 feet to the East right of way line of Youngfield Street; thence SO°44'16"E, 1650.10 feet to the point of beginning. Except the following parcel of land which is described as follows: Beginning at a point which lies 1,306.06 feet, S73°22'02"W, (S89°33'W, 1,256.16 feet, S0044116"h, 364.01 feet) from the North 1/4 corner of Section 29, Township 3 South, Range 69 West of the 6th P.M., which point is also the Northwest corner of Ridge Subdivision, as filed in the Records of Jefferson County, Colorado, and which point lies N69°.i3'L, 60.0 feet, SO°44'16"E, 364.01 feet from the Northwest corner of the Northeast 1/4 of the Northwest 1/4 of said Section 29, thence running N64°25'23"E, a distance of 495.87 feet, along the North line of Ridge Subdivision, thence NO°44'26"W, a distance of 1,772.95 feet, thence S75°06'42"W, a distance of 462.77 feet to a point on the East right-of-way line of Youngfield Street, thence SO°44'16"E, a distance of 1,873.25 feet to the Point of Beginning. Together with a 50 foot nonexclusive easement over and across tract as described hereinabove for ingress, egress and utility lines, said 50 foot easement to run parallel with and measured perpendicular to the Northerly line of said tract and to be the Southerly 50 feet located within the Northerly 150 feet of said tract, also together with a 50 foot non- exclusive easement over and across the Northerly 55.10 feet of the South 80.10 feet of the tract as described hereinabove for ingress, egress and utility lines, said easement to be parallel to the Southerly line of said tract with the 50 foot dimension being measured perpendicular to the South line of said tract. This parcel contains approximately 18.83 acres. Also to exclude Parcel Two (2) from no zoning, classification and to include in the Agricultural Two (A-2) District the following described land: Parcel Two Beginning at a point on the East right of way line of Youngfield Street, from which point the quarter corner between said Section 20 and 29 bears N73°22'52"E, 1306.06 feet, and which point is also the Northwesterly corner of Ridge Subdivision; thence N64°25'23"E along the northerly line of Ridge Subdivision, 1112.40 feet; thence NO°0'40"E, 180 feet; thence N58°57'43"E, 195 feet; thence S84°26'05"E, 165.73 feet to the West line of a parcel of land described in Book 759 at page 462 of Jefferson County records; thence NO°05'34"W along said West line, 1082.95 feet to the North line of said tract described in Book 759 at page 462, said point being the true point of beginning; thence S87°58'E along the North line of said tract, a distance of 485 feet more or less; thence S00°29'57"E a distance of 135 feet more or less; thence westerly 470 feet more or less; thence N00°05'34"W a distance of 160 feet more or less to the true point of beginning.. Section 2. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legis- lative object to be attained. Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 4. This ordinance shall take effect 15 day after final publication.
