ORDINANCE NO. 432
SERIES OF 1930
TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
PESTRICTED COMMERCIAL (R-C) TO COP'L^4ERCIAL ONE
(C-1) FOR LAND LOCATED AT APPROXIMATELY 3050 YOUNGFIELD STEEET,
CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO,
THAT:
Section 1. Upon application of Ochs Brothers for approval of rezoning
in Wheat Ridge, Colorado, Case No. WZ-30-30, and based upon recommen-
dation for approval from the Wheat Ridge Planning Commission and pur-
suant to findings made based on testimony and evidence presented at
public hearing before the Wheat Ridge Citv Council, Wheat Ridge maps
are hereby amended to exclude from the Restricted Commercial District
and to include in the Commercial One District the following described
land:
That part of the Northeast one-quarter of the Southwest one-quarter
of Section 29, Township 3 South, Range 69 West of the 6th P.M.,
described as follows: Beginning at a point 100 feet North and 39
feet East of the Southwest corner of the Northeast one-quarter of
the Southwest one-quarter of said Section 29, which point is on the
East line of Youngfield Street as presently constructed and is the
Northwest corner of that parcel described in Book 909 at Page 356,
Jefferson Countv Records; thence North along the East line of Young-
field Street, a distance of 464 feet; thence East and parallel with
the South line of said Northeast one-quarter of the Southwest one-
quarter of said Section 29, 353 feet, to a point on the West line
of Resubdivision of Maple Grove Village, Block One, according to
the recorded plat thereof, thence along said West line, a distance
of 564 feet to a point on the South line of the said Northeast one-
quarter of the Southwest one-quarter of said Section 29; being 275
feet West of the Southeast corner of the West one-half of the North-
east one-quarter of the Southwest one-quarter; thence West along
the South line of said Northeast one--quarter of the Southwest one-
quarter, 197 feet to the Southeast corner of that parcel described
in Book 909 at Page 356; thence North along the East line of said
parcel, 100 feet to the Northeast corner of said parcel; thence
West, along the North line of said Parcel 150 feet to the point of
beginning, County of Jefferson, State of Colorado.
Except that portion conveyed to Forrest D. Terry by Warranty Deed
recorded December 16, 1971 in Book 2326, Page 469; more particular-
ly described as follows:

quarter of the Southwest one-quarter of said Section 29 203 feet
to a point on the West line of Resubdivision of Maple Grove Village,
Block One, according to the recorded plat thereof, thence along
said West line, a distance of 564 feet to a point on the South line
of the said Northeast one-quarter of the Southwest one-quarter of
said Section 29; Being 275 feet West of the Southeast corner of
the West one-half of the Northeast one-quarter of the Southwest
one-quarter; Thence West along the South line of said Northeast
one-quarter of the Southwest one-quarter, 197 feet to the Southeast
corner of that parcel described in Book 909 at Page 356, thence
North, along the East line of said parcel, 100 feet to the North-
east corner of said parcel thence West, along the North line of
said Parcel 150 feet to the point of beginning.

Section 2, Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the general
police power of the City of Wheat Ridge, that it is promulgated for
the health, safety, and welfare of the public, and that this ordinance
is necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council further
determines that the ordinance bears a rational relation to the proper
legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to anv person or
circumstances shall for any reason be adjudged by a court of competent
jurisdiction invalid, such judgment shall not affect, impair or
invalidate the remainder of this ordinance or its application to
other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to
0 on this 24th day of November, 1980; ordered published in
full in a newspaper of general circulation in the City of Wheat Ridge
and Public Hearing and consideration on final n_assage set for December
15 , 1980, at 7:30 o'clock n.m., in the Council Chambers,
7500 west 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a
vote of 5 to 2 , this 15th day or December , 1980. SIGNED
