ORDINANCE NO. 434

TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A ZONING MAP
CORRECTION FOR PARCEL A FROM INDUSTRIAL (I) AND COMMERCIAL
ONE (C-1) TO INDUSTRIAL (I) AND A ZONING MAP CORRECTION FOR
PARCEL B FROM COMMERCIAL ONE (C-1), INDUSTRIAL (I) AND NO
ZONING TO AGRICULTURE ONE (A-1) FOR LAND LOCATED AT APPROXI-
MATELY 4975 MILLER (PARCEL A) AND 4951 MILLER (PARCEL B).
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO,
THAT:
Section 1. Upon application of the City of Wheat Ridge for approval of
a zoning man correction in Wheat Ridge, Colorado, Case No. WZ-78-39D
and based upon recommendation for approval from the Wheat Ridge Planning
Commission and pursuant to findings made based on testimony and evidence
presented at public hearing before the Wheat Ridge City Council, Wheat
Ridge maps are hereby corrected to exclude from the Industrial District
(I) and Commercial One (C-1) District and to include in the industrial
(I) District the following described land:
Parcel A: A parcel of land in the SW 1/4 SE 1/4 of Section 16, Town-
ship 3 South, Range 69 West of the 6th P.M., County of
Jefferson, State of Colorado, lying within the following
described tract of land, to wit: Beginning at a point
whence the Southeast corner of the SW 1/4 of the SE 1/4 of
said Section 16 bears SouthO030'West, 961.0 feet; thence
NorthO030'East, 359.0 feet; thence North89042'West,
1332.0 feet; thence South 0°30'West, 728.0 feet; thence
North74043'East, 1377.8 feet to the Point of Beginning;
Except that tract of land conveyed by deed recorded
January 23, 1923 in Book 239 at Page 498, said tract described
as follows: Beginning at the northeast corner of the SW 1/4
of the SE 1/4 of said Section 16; thence Southerly 30 feet;
thence Westerly 360 feet; thence Northerly 30 feet; thence
Easterly 360 feet to the point of beginning and except that
tract of land conveyed in instrument recorded July 22, 1971
in Book 2281 at Page 211, more particularly described as
follows: Beginning at a point whence the Southeast corner
of the SW 1/4 of the SE 1/4 of said section bears SO°30'W
961.0 feet; thence S74043'W 31.19 feet to the point of
beginning, said point being 30 feet west of said North-South
centerline, thence continuing Southwesterly along said course
a distance of 404.297 feet; thence North with the North-South
centerline 112.00 feet; thence N74°43'E 404.297 feet to a
point 30 feet west of the North-South centerline thence South
parallel to and 30 feet west of said North-South centerline,
a distance of 112.00 feet to the true point of beginning;
and except the East 30.00 feet as reserved for Miller Street,
and subject to an easement and right of way to construct, lay,
maintain, remove, repair, operate, change or alter water
pipelines and hydrants, together with their appurtenances
and together with the necessary manholes and lampholes and
the perpetual right of way for ingress and egress thereto
and therefrom for the foresaid purposes, over, under and
across the following described property as granted to the
Vallev Water District in instrument recorded in Book 2197
at Page 477, more particularly described as follows: the
North 60 feet of the East 360 feet, and the North 30 feet
of the West 240 feet of the East 600 feet of the SW 1/4 of
the SE 1/4 of Section 16, Township 3 South, Range 69 West
of the 6th P.M., containing 14.96 acres, more or less.
Also to exclude from the Commercial One (C-1) District, the Industrial
(I) District and no zoning and to include in the Agriculture One (A-1)
District the following described land:

Parcel B: Beginning at a point whence the Southeast corner of the
SW 1/4 of the SE 1/4 of said section bears SO°30'W 961.0
feet; thence S74°43'19 31.19 feet to the point of beginning,
said point being 30 feet west of said North-South center-
line, thence continuing Southwesterly along said course a
distance of 404.297 feet, thence North with the North-South
centerline 112.00 feet; thence N74043'E 404.297 feet to a
point 30 feet west of the North-South centerline, thence
South parallel to and 30 feet West of said North-South
centerline, a distance of 112.00 feet to the True Point of
Beginning.
Section 2. Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the general police
power of the City of Wheat Ridge, that it is promulgated for the health,
safety, and welfare of the public, and that this ordinance is necessary
for the preservation of health and safety and for the protection of
public convenience and welfare. The City Council further determines
that the ordinance bears a rational relation to the proper legislative
object to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part
of this ordinance or the application thereof to any person or circumstances
shall for any reason be adjudged by a court of competent jurisdiction
invalid, such judgment shall not affect, impair or invalidate the
remainder of this ordinance or its application to other persons or
circumstances.
Section 4. This ordinance shall take effect 15 day(s) after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 7 to 0
on this 8th day of December , 1980; ordered published in full
in a newspaper of general circulation in the City of Wheat Ridge and
Public Hearing and consideration on final passage set for Monday,
January 12 , 1981, at 7:30 o'clock p.m., in the Council Chambers,
7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a
vote of 7 to 0 this 12th day of January 1981.
