Section 1. Appendix A, Zoning Ordinance, of the Code of the City
of Wheat Ridge, Colorado, is hereby amended by the addition of
Section 11.1 to read as follows:
bection 11.1: Residential-Three - Elderly District (R-3E)
ST A' E 1EA' OF INTENT: This section is intended to provide for the
orderly development of multi-unit housing for the senior citizens
of the City of 4heat Ridge. Multi-unit elderly housing applies to
developments which are exclusively devoted to the housing of
elderly persons wherein all of the residents must be at least 62
years or older. This regulation applies to private, public, or
quasi-public ownership.
A. UbE REGULATIONb: The following uses are allowed:
1. Multi-unit elderly housing of 1 and 2 bedroom
units.
a. COA PLIANCE CERTIFICATION: The Owner/Operator of any
Multi-unit Elderly Housing Development must certify
that the development is in compliance with these
regulations on an annual basis based on the date of the
original certificate of occupancy. Such certification
shall oe made upon forms supplied by the City of ;dheat
Ridge for that purpose.
C. SITE PLAN: A site plan, which shall be approved by
the City Council after a recommendation by the Planning
Commission, will be required under the following
conditions:
1. For developments with more than one building on a
site.
2. For developments with density of over fourteen
units per acre.
3. For developments which include buildings over 35
feet in height.
4. ]here reduced lot area is requested as a bonus for
providing indoor recreational facilities.

E. AREA REGULATIONS:
l.a. Area of Lot. For every multi-family building or
structure erected or structurally altered there shall
be provided a minimum gross lot area of twelve thousand
five hundred (12,500) square feet and a minimum area of
one thousand seven hundred and fifty (1,750) square
feet for each family unit constructed thereon.
b. Allowance for Recreation Areas Inside of
Buildings. If approved as part of a site plan, the lot
area requirement may be reduced by up to five percent
if an equal amount of square footage is utilized within
the building for recreation space such as a game room
or a clubhouse for the residents.

2. width of Lot. Tne minimum width of such lot for
raulti-unit elderly dwellinq shall be one hundred (100)
feet.
3. Front Yard. The minimum depth of front yard for
each dwelling or other main building shall be thirty
(30) feet when the front yard is adjacent to a
dedicated public street. The minimum depth of front
yards which front exclusively on the bulb of the
cul-de-sac shall be ten (10) feet. Private garages and
accessory buildings shall have a minimum setbacx of
thirty (30) feet. where height of structures exceed
thirty five (35) feet, the front yard shall be thirty
(30) feet plus five (5) feet for each additional five
(5) feet of height. Due to unique topographical or
other physical surrounding situations, increased set-
back requirements may be imposed as a condition of
Site Plan approval.
4. Side Yard. The minimum width of side yard for
any building shall be five (5) feet per story. The
minimum width of side yard adjacent to a dedicated
street shall he thirty (30) feet, unless structures
exceed thirty five (35) feet in height, then an
additional five (5) feet of setback for each five (5)
feet of height shall be required. Due to unique topo-
graphical or other physical surrounding situations,
increased setback requirements may be imposed as a
condition of Site Plan approval.
5. Rear Yard. The minimum depth of rear yard for any
building shall be five (5) feet per story.
b. Lot Coverage. No more than seventy five (75)
percent of total area shall be covered by structures
and surfacing. That area not covered by structures or
surfacing, shall be landscaped.
F. PARKING. The following parkinq regulations shall apply
to multi-unit elderly housing.
1. One space for each dwelling unit up to and
including the first 12 units, .75 spaces per unit for 1
and 2 bedroom units over the first 12 units.
G. Fences, walls, and obstructions to View.
1. No fence, wall, hedge or other structure, other
than a main structure, shall exceed a height of
forty-two (42) inches or shall be erected, placed or
maintained within fifty-five (55) feet of an
intersection of two (2) or more street right-of-way
lines.

3. No type of tree, plant, sign, fence, wall, hedge or
other obstruction to vision shall be placed or retained
in such a manner as to obstruct vision at any
intersactinn of streets or cause a traffic hazard.

5. Fence types prohibited:
a. Fences carrying electric current
b. Any fence, if in the opinion of the chief
building inspector, that could constitute
a hazard to the health of any person (Ord.)

e. Recreational Fences and Lightinq:
a. Open fences (over 80% open) may be constructed
to a height not to exceed 10 feet for the uses
listed below. Such fences shall conform to
all setback requirements for structures in
this district:

Golf Driving Ranges

Goals and Backstops

Other similar uses
b. Lighting structures for recreational uses shall not
exceed the maximum height for structure in this
district.
c. ',dhere it is desired to exceed the standards as
determined in a or b above, approval must be by Special
Use Permit from the Planning Commission and City
Council after proper notification by posting of a sign
on the subject property not less than 15 days prior to
the date of public hearing.
Section 2. Safety_ Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated tinder
the general police power of the City of 'Aeat Ridge, that it is
promulgated for the health, safety, and welfare of the public, and
that this ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare.
The City Council further determines that the ordinance bears a
rational relation to the proper legislative object to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judqment shall not affect,
impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 4. This ordinance shall take effect _15_ days after final
publication.
