TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
AGP.ICULTU?,AT-ONE (A-1), AGRICULTURAL-TWO (A-2), AND
RESIDENTIAL-ONE (R-1) TO RESIDE'r7'^IAL-ONE (R-1) FOR LAidD
LOCATED AT APPROXIMATELY 11305 W. 387-H AVENUE, CITY OF
WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COU14CIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. Upon application of Apple Ridge, Inc. for approval of
rezoning in Wheat Ridge, Colorado, Case No. WZ-80-35, and pursuant
to findings made based on testimony and evidence presented at
public hearing before the Wheat Ridge City Council, Wheat Ridge
maps are hereby amended to exclude from the Agricultural-One (A-1),
Agricultural-Two (A-2), and Residential-One (R-1) District and to
include in the Residential-One (R-1) District the following
described land:
A portion of the East One-I:alf of Block 6, Brookside
Subdivision, in the County of Jefferson, more partic-
ularly described as follows:
Commencing at the Southwest Corner of Section 21,
Township 3 South, Range 69 West of the Sixth (6th)
Principal Meridian, County of Jefferson, State of
Colorado; thence easterly along the sout'i line of
the said Section. 21, a distance of 824.12 feet;
thence PIOOo00'00"E, a distance of 30.00 feet to the
true point of beginning; thence N00000'00"E, a dis-
tance of 820.00 feet; thence N56000'50"E, a distance
of 198.57 feet; thence SOOo00'00"E, a distance of
931.00 feet; thence S90000'00"W, a distance of 25.00
feet; thence N00000'00"E, a distance of 135.00 feet;
thence S90000100"W, a distance of 125.00 feet; thence
SOOoOO'00"E, a distance of 135.00 feet; thence
S90000'00"W, a distance of 14.65 feet to the true
point of beginning, containing 2.92 acres.
Section 2. Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the general
police power of the City of Wheat Ridge, that it is promulgated for
the health, safety, and welfare of the public, and that this
ordinance is necessary for the preservation of health and safety
an~ nor the protection of public convenience and welfare. The City
Council further determines that the ordinance bears a rational
relation to the proper legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final
publication.
