HomeMy WebLinkAboutOrdinance-1981-0450INTRODUCED BY COUNCIL MEMBER ORE ORDINANCE NO. 4E0 Series of 1981 TITLE: AN ORDINANCE REPEALING AND REENACTING SECTION 18-31 OF THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE RELATING TO SALARIES TO BE PAID TO MEMBERS OF THE CLASSIFIED SERVICE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: Section 1. Section 18-31 of the Code of Laws of the City of Wheat Ridge is hereby repealed and reenacted as follows: "Section 18-31. Salaries. The salaries for the members of the classified service shall be annually established by the City Council, in the exercise of its legislative discretion. The City Council shall annually cause a salary survey to be undertaken, either by the City Administration or by a third party, of the pay scales of similar cities within the Denver metropolitan area for the purpose of determining what wages are generally prevailing in those surveyed cities for similar work performed (without regard to title, but only with regard to duties and responsibilities attendant to the position surveyed). Upon receipt of said salary survev,the City Council shall, no less than annually, enact a Resolution providing for wages equivalent to those generally prevailing for such similar work in the similar surveyed cities, subject only to the existence of economic conditions which, in the legislative discretion of the City Council, preclude or render impossible the payment of such parity pay." Section 2. Purpose. The purpose of this ordinance is to clearly enunciate the exclusive legislative authority of the City Council in budget related matters and to ensure that parity pay is provided to Wheat Ridge employees so long as economic conditions do not preclude such parity pay. Subject to the condition above stated relating to economic conditions, the payment of parity pay is a priority of the City Council. Section 3. Safety Clause. The City Council hereby finds, determines and declares that this ordinance is promulgated under the police power of the City of Wheat Ridge; that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to these objectives. Section 4. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other person or circumstances. Section 5. This ordinance shall take effect 1 day after final publication.
