ORDINANCE NO. 453

TITLE: AN ORDINANCE REPEALING AND REENACTING SECTIONS 17-1 AND
17-2 OF THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE,
ADOPTING BY REFERENCE THE ICBO PLUMBING CODE,1979 EDITION
PROVIDING FOR CERTAIN AMENDMENTS THERETO, AND PROVIDING
PENALTIES FOR VIOLATIC'+ THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO:
Section 1. Section 17-1 of the Code of Laws of the City of Wheat
Ridge is hereby repealed and reenacted as follows:
The ICBO Plumbing Code by the International Conference
of Building Officials is hereby adopted by reference and incorporated
into this article as though fully set forth herein as the ICBO
Plumbing Code of the City of Wheat Ridge. Three (3) copies of
said ICBO Plumbing Code shall be filed in the office of the City
Clerk and may be inspected during regular business hours. Except
as otherwise provided hereafter, such Code is adopted in full,
h outline of contents, index and appendixes contained
therein.
Section 2. Section 17-2 of the Code of Laws of the City of Wheat
Ridge is hereby repealed and reenacted as follows:
"Section 17-2. Amendments. The "ICBO Plumbing Code" 1979
edition, adopted by Section 17-1 hereof is hereby amended
as follows (section numbers referred to herein refer to
and correspond with the section numbers of the ICBO Plumbing
Code):
(a) Section 203. Board of Appeals. This section shall be
deleted and in its place the following sentences shall be
added:
"In order to determine the suitability of alternate materials
and methods of installation, and provide reasonable inter-
pretation of the provisions of this Code, The Building Code
Advisory Committee previously established by Chapter 5 of
the Code of Ordinances of the City, shall have authority
to hear and decide those matters delegated to it, and all
matters requiring use of a Board of Appeals by this Plumbing
Code."
(b) Section 304. Permit Fees. This section shall be
deleted and in its place the following sentences shall be
added:
"Any person desiring a permit required by this Code, shall,
at the time of filing an application therefor, pay a fee to
the City Treasurer. Permit fees shall be as established
by Ordinance."
(c) Section 306. Table 3-A. Delete Table 3-A in its
entirety.
(d) Section 602. Materials--General. Amend Section 602(a)
by adding the following sentence to the first paragraph:
"Plastic pipe meeting the standards in Table 6-A are approved
for use only in residential construction no more than two
stories in height."
Section 3. Any provision of the Code of Laws of the City of Wheat
Ridge which is inconsistent with or contrary to any of the provisions
hereof is expressly repealed hereby.

Section 4. Violation and Penalties. Any person, firr., association, or other
entitN/ doing any act or onission in violation of this Code hereby enacted shall
be guilty of a misdemeanor and, upon convic J on thereof, shall be subject to a
fine not to exceed $300.00, inprisonnent not to exceed gC da,,s, or both such
fine and irrprisonment.
Section S. Safety Clause. The Cif-w Council hereby finds, determines
A decla.,-es that this ordinance lc ;,romulgatecd under the police
_.wer of the City of Wheat Ridge; th it is promulgated for the
health, safety and welfare of the public, and that this ordinance
is necessary for the preservation of health and safety for the pro-
tection of public convenience and welfare. The City Council
further determines that the ordinance bears a rational relation
to these objectives.
Section 6. Severability. If any clause, sentence, paragraph or part
of this ordinance or the application thereof to any person or circum-
stances shall for any reason be adjudged by a court of competent
jurisdiction invalid, such judgment shall not affect, impair or
invalidate the remainder of this ordinance or its application to
other persons or circumstances.
Section 7. This ordinance will take effect 1 day after final
publication.
