HomeMy WebLinkAboutOrdinance-1981-0473-INTRODUCED BY COUNCILMEMBER Lewis ORDINANCE NO. 473 Series of 1981 TITLE: AN ORDINANCE AMENDING CHAPTER 21 OF THE CODE OF LAWS OF THh CITY OF WHEAT RIDGE RELATING TO TAXATION BY INCLUDING CERTAIN ITEMS AS SUBJECT TO TAXATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: Section 1. Section 21-4(b) of the Code of Laws of the City of Wheat Ridge is hereby repealed and reenacted as follows: "(b) Upon the charge for services within the City for telephone and telegraph service and televised audio and video messages carried by wire, cable, or microwave." Section 2. Section 21-4 of the Code of Laws of the City of Wheat Ridge is amended by adding thereto the following Sections (h), (i) and (j) : "(h) On the entire amount charged for clothing purchased at retail. (i) Upon 'used merchandise' which has previously been purchased and which has been remanufactured or rebuilt and, as so remanufactured or rebuilt, been sold to a subsequent owner. (j) Upon farm equipment not titled or registered as a motor vehicle." Section 3. Section 21-12(b) of the Code of Laws of the City of Wheat Ridge is hereby repealed and reenacted as follows: "(b) Tangible, personal property which, if it were sold at retail within the City, would be exempt from sales tax under the provisions of Section 21-5, with the exception of disposable medical accessories, including, but not limited to, hypodermic syringe and needles or related accessories." Section 4. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 5. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 6. This ordinance shall take effect 1 day after final publication.
