REZONINQ FROM A~7FICULTURAL ONE (A-1) TO INDUSTRIAL (I) AND APPROVAL OF A PRELIMINARY DEVELOPMENT PLAN AND PLAT ON DROPERTY LOCATED AT APPROXIMATELY 4955 MILLER STREET, CITY OF WHEAT FIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO THAT: Section 1. Upon application of Leroy and Jessie Reich I-or approval of rezoning and a Preliminary Development Plan and Flat in Wheat Ridge Case No. WZ-81-3, and upon recommendation for approval from the Wheat Ridge Planning Commission, and persuant to findings made based upon testimony and evidence presented at Public Hearing before the Wheat Ridge City Council. Wheat Ridge Maps are hereby amended to exclude from the Agricultural One (A-1) and to include with the Industrial (I) zone district, and to approve the Preliminary Development Plan and Plat for the following described land: That part of the SW 1/4 of the SE 1/4 of S-c ti_,n 16, Township 3 South, Range 69 West of the 6th P.M., City of Wheat Ridge, County of Jefferson, State cf Colorado, more particularly described as follows Commencing at the southeast corner of the SW 1/4 of the SE 1/4 of said Section 16; thence N 01 30' 00" E (assumed basis of bearings) along the east line of the SW 1/4 of said Section 16, a distance of 646.00 feet to the True Point of Beginning, thence continuing N 01 30' 00" E, along said east line, a distance of 212.02 feet to a point on the southerly right-of-way line of the abandoned Tramwav right-of-way; thence S 741 52' 56" W, along the southerly right-of-way line of the abandoned Tramwav right-of-wav, a distance of 797.29 feet, thence S 891 41' 45" E, a distance of 767.86 feet to the True Point of Beginning, containing 1.726 acres, more or less. Section 2. Safety Clause. The City Council hereby finds, determines and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severability. If an or part of this ordinance or the person or circumstances shall fo enurt of competent jurisdiction not .affect, impair or invalidate y clause, sentence, paragraph, application thereof to any r any reason be adjudged by a invalid, such judgment shall the remainder of this ordinance nr its application to other persons or circumstances. Section 4. This ordinance shall take effect 15 days after final publication.
