TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM RESTRICTED COM-
MERCIAL (R-C) and COMMERCIAL-ONE (C-1) TO PLANNED COMMERCIAL DEVELOPMENT
(PCD) AND APPROVAL OF COMBINED PRELIMINARY AND FINAL DEVELOPMENT PLAN ON
LAND LOCATED AT APPROXIMATELY 7360 W. 44TH AVENUE, CITY OF WHEAT RIDGE,
COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon application of Eagle Land Company for approval of rezoning and
combined Preliminary and Final Development Plan in Wheat Ridge, Colorado, Case
No. WZ-81-19, and based upon recommendation for approval from the Wheat Ridge
Planning Commission and pursuant to findings made based on testimony and evidence
presented at public hearing before the Wheat Ridge City Council, Wheat Ridge maps
are hereby amended to exclude from the Restricted Commercial and Commercial-One and
to include in the Planned Commercial Development District, and also does approve
combined Preliminary and Final Development Plan on the following described land:
A portion of the East 1/2 of the Northwest 1/4 of the Northwest 1/4 of the
Southeast 1/4 of Section 23, Township 3 South, Range 69 West, Jefferson County,
Colorado, being more particularly described as follows: Commencing at the
center 1/4 corner of the above described Section 23; thence N89°56'20"E along
the north line of the Southeast 1/4 of Section 23, 328.49 feet to a point;
thence SO0°03'46"W 30.00 feet to a point on the south edge of the 44th Avenue
rights-of-way which is also the True Point of Beginning; thence SO0°03'46"W
714.04 feet along the west line of the East 1/2 of the Northwest 1/4 of the
Northwest 1/4 of the Southeast 1/4 of Section 23 to a point; thence
S89°55'37"E 138.89 feet; thence N00°04'23"E 2.40 feet; thence S89°55'37"E
189.82 feet; thence N00°02'46"E 219.78 feet; thence S89°55'50"W 8.45 feet;
thence N00°02'46"E 134.00 feet; thence N89°55'50"E 8.45 feet; thence
N00°02'46"E 358.63 feet; thence S89°56'20"W 328.50 feet, to the True Point
of Beginning.
Section 2. Safety Clause. The City Council hereby finds, determines, and declares
that this ordinance is promulgated under the general police power of the City of
Wheat Ridge, that it is promulgated for the health, safety, and welfare of the
public, and that this ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare. The City Council
further determines that the ordinance bears a rational relation to the proper
legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall for any
reason be adjudged by a court of competent jurisdiction invalid, such judgment
shall not affect, impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on this
11th day of January , 1982; ordered published in full in a newspaper
of general circulation in the City of Wheat Ridge and Public Hearing, and consideration
on final passage set for February 8, , 1982, at 7:30 o'clock p.m., in the
Council Chambers, 7500 West 29th Avenue; Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a vote of 5
to 3 , this 8th day of February , 1982.
SIGNED by the Mayor on this 9th day of February 1982.
