HomeMy WebLinkAboutOrdinance-1982-0486INTRODUCED BY COUNCILMEMBER MERKL ORDINANCE NO. 486 Series of 1982 TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM RESIDENTIAL-THREE (R-3) AND RESIDENTIAL-TWO (R-2) TO PLANNED RESIDENTIAL DEVELOPMENT (PRD) AND AN OUTLINE DEVELOPMENT PLAN ON LAND LOCATED AT APPROXIMATELY 6300 W. 38TH AVENUE, CITY OF MEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Upon application of United Presbyterian Association for approval of rezoning and an Outline Development Plan in Wheat Ridge, Colorado, Case No. WZ-81-28 and based upon recommendation for approval from the Wheat Ridge Planning Commission and pursuant to findings made based on testimony and evidence presented at public hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby amended to exclude from the Residential-Three and Residential-Two Districts and to include in the Planned Residential Development District, and also does approve an Outline Development Plan on the following described land: The West half of the West half of the Northeast quarter of the Northwest quarter of Section 25, Township 3 South, Range 69 West of the 6th P.M. except the North 30 feet thereof and except the South 377 feet of the West half thereof, and except the South 25 feet thereof, City of Wheat Ridge, County of Jefferson, State of Colorado, more particularly described as follows: Commencing at the Northwest corner of the Northeast quarter of the Northwest quarter of said Section 25, thence SO°05'35"E along the West line of said Northeast quarter of the Northwest quarter 30.00 feet to the Point of Beginning: thence continuing along said West line SO°05'35"E 921.09 feet to a line 377 feet North of the South line of said Northeast quarter of the Northwest quarter; thence S89°56'57"E along said line 165.51 feet to the East line of the West half of the West half of the West half of said Northeast quarter of the Northwest quarter; thence SO°05'45"E along said East line 352.10 feet to a line 25 feet North of the South line of said Northeast quarter of the Northwest quarter; thence S89°57'10"E along said line 165.59 feet to the East line of the West half of the West half of said Northeast quarter of the Northwest quarter; thence N0°05'21"W along said line 1272.66 feet to a line 30 feet South of the North line of said Northeast quarter of the Northwest quarter; thence N89°51'34"W along said line 331.21 feet to the Point of Beginning, containing 363,263 square feet or 8.3384 acres, more or less. Section 2. Conditions. This is approval of a change of zone from R-2 and R-3 to Planned Residential Development (PRD) and approval of an Outline Development only. As such, it is understood that only use of land, density, generalized character of development, building height, and generalized site layout and building envelope is hereby approved. Specific design, building location and platting details shall be reviewed and approved or disapproved as part of a Preliminary and/or Final Development Plan and Plat. Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 5. This ordinance shall take effect 15 days after final publication. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on this 25 day of January , 1982; ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for February 22 1982, at 7:30 o'clock P.M., in the Council Chambers, 7500 West 29th Avenue; Wheat Ridge, Colorado.
