~TITLE: AN ORDINANCE VACATING A PORTION OF KLINE STREET LOCATED
SOUTH OF WEST 44TH AVENUE WITHIN THE CITY OF 4HEAT RIDGE, '
COLORADO, AS MORE FULLY DESCRIBED HEREIN.
WHEREAS, a certain street was dedicated to the public;
and
WHEREAS, that part of the following described street is
no longer necessary for use by the public; and
WHEREAS, that part of said street is within the limits of
the City of Wheat Ridge, Colorado; and
WHEREAS, no land would, by a vacation of part of said
street, be left without an established public road connecting it
with another established public road; and
WHEREAS, the Wheat Ridge Planning Commission has approved
the vacation of part of said street.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. The following part of said street in the City of
Wheat Ridge, County of Jefferson, Colorado, be vacated to wit:
That portion of Blevins Subdivision described as Kline
Street including all of Tracts "B" and "C" and all except
the northerly fifty feet of Tract "A" recorded in Book
29, Page 23, Map 14 of the Jefferson County Records.
And the same is hereby approved and that part of said street as
described is hereby vacated; provided, however, said vacation
shall be subject to the following conditions and reservations:
There is reserved to the City of Wheat Ridge, an easement
for parks and open space purpose to construct, operate,
and maintain facilities for public access in said vacated
street as described hereafter:
That particular ten foot wide strip immediately east of
the west boundary of Blevins Subdivision and southerly of
the south line of West 40th Avenue, both as described on
Blevins Subdivision as recorded in Book 29, Page 23, Map
14 of the Jefferson County Records. Said ten foot wide
strip is more particularly described as follows: The
westerly nine feet of that portion of Blevins Subdivision
described as Kline Street and all except the northerly 50
feet of Tract "A" and the southerly projection of the
just described 10 feet through Tract "B".
Section 2. The provisions of this ordinance are necessary to the
immediate preservation of the public health and safety of the
citizens of the City of Wheat Ridge, Colorado, for the following
reasons:
1. That said property is not needed for public use.
Section 3. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public,
and that this ordinance is necessary for the preservation of
health and safety and for the protection of public convenience
and welfare. The City Council further determines that the
ordinance bears a rational relation to the proper legislative
object sought to be attained.

Section 4. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof' to any person
or circumstances shall for any reason be adjudged oy a court of
competent jurisdiction invalid, such judgment shall not affect,
i!npair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 5. This ordinance shall take effect 1 day after
final publication.
