HomeMy WebLinkAboutOrdinance-1982-0499INTRODUCED BY COUNCILMEMBER DAVIS ORDINANCE NO. 499 Series of 1982 TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A REZONING FROM RESIDENTIAL- THREE TO COMMERCIAL ONE WITH CONDITIONS FOR LAND LOCATED AT APPROXIMATELY 6701 W. 44TH AVE: CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Upon application of George Leman for approval of rezoning in Wheat Ridge, Colorado, Case No. WZ-82-9, and based upon recommendation for approval from the Wheat Ridge Planning Commission, and pursuant to findings made based on testimony and evidence presented at public hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby amended to exclude from the Resi- dential-Three District and to include in the Commercial-One District the following described land: A part of Block 7, LAKE VIEW SUBDIVISION and the SW1/4 of the NW1/4 of Section 24, Township 3 South, Range 69 West of the 6th P.M., being more particularly described as follows; Beginning at the West quarter corner of said Section 24, thence N90°00'00"E on an assumed bearing along the East-West centerline of said Section 24, a distance of 256.50 feet; thence N00°15'42"W, a distance of 30.00 feet to the TRUE POINT OF BEGINNING, which point is on the Northerly right-of-way line of West 44th Avenue; thence continuing NO0°15'42"W, a distance of 140.55 feet to a point 140.00 feet South of the Southerly right-of-way line of West 44th Place; thence S81°51'20"E parallel with said Southerly right-of-way line, a distance of 75.53 feet to a point on the East line of the West 331.50 feet of Block 7, LAKEVIEW SUBDIVISION: thence S00°15'43"E, a distance of 140.36 feet to a point on the Northerly right-of-way line of West 44th Avenue; thence N90°00'00"W along said Northerly right-of-way line, a distance of 75.53 feet, more or less, to the TRUE POINT OF BEGINNING. Section 2. Conditions. Use of this Commercial-one zoned parcel described above shall be conditional on the following: 1. A six foot high screening fence shall be erected across the north property line abutting residential zoned properties. Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 5. This ordinance shall take effect 15 days after final publication. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 6 to 0 on this 28th day of June , 1982; ordered published in full in a news- paper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for _July 26 , 1981, 7.30 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue; Wheat Ridge, Colorado.
