TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM RESIDENTIAL
THREE (R-3) AND COMMERCIAL-ONE (C-1) TO PLANNED COMMERCIAL DEVELOPMENT
(PCD) AND APPROVAL OF A COMBINED PRELIMINARY AND FINAL DEVELOPMENT PLAN
AND PLAT ON LAND LOCATED AT APPROXIMATELY 9801 WEST 50TH AVENUE, CITY
OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon application by Kipling 5000, Ltd. for approval of rezoning
and a combined Preliminary and Final Development Plan and Plat in Wheat Ridge,
Colorado, Case No. WZ-82-12 and based upon recommendation for approval from the
Wheat Ridge Planning Commission and pursuant to findings made based on testimony
and evidence presented at public hearing before the Wheat Ridge City Council,
Wheat Ridge maps are hereby amended to exclude from the Residential-Three and
Commercial-One and to include in the Planned Commercial Development District,
and also does approve a combined Preliminary and Final Development Plan and Plat
on the following described land:
A portion of Kipling 5000 Plaza Subdivision and a portion of the
Northwest 1/4 of the Southwest 1/4 of Section 15, Township 3 South,
Range 69 West of the 6th Principal Meridian, Jefferson County,
Colorado, more particularly described as follows: Commencing at the
Northeast horner of Lot 4 of said Kipling 5000 Plaza Subdivision;
thence SOO 25'00"W along the east line of said Lot 4, 70.00 feet
to She True Point of Beginning on tge East line of said Lot 4; thence
S88 44'56"E 135.01 feet; thence SOO 25'00"W 442.16 feet to a pobnt on
the Northerly right of way line of West 50th Avenue; thence S7A 0814411tv
along said Northerly right of way line 295.12 feet; thence NOD 02'00"W
along the west line of Lot 5, Kipling 5000 Plaza Subdivision 410.62
feet to the Northwest corner of said Lot 5; thence N89 58'00"E along
the North line of said Lot 5 a 5stance of 151.53 feet to the Southeast
corner of said Lot 4; thence NOD 25'00"E along the East line of said
Lot 4, 115.01 feet to the True Point of Beginning, containing 2.776
acres more or less therein.
Section 2. Safety Clause. The City Council hereby finds, determines, and declares
that this ordinance is promulgated under the general police power of the City of
Wheat Ridge, that it is promulgated for the health, safety, and welfare of the
public, and that this ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare. The City Council
further determines that the ordinance bears a rational relation to the proper
legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall for any
reason be adjudged by a court of competent jurisdiction invalid, such judgment
shall not affect, impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final publication.
INTRODUCED, READ AND ADOPTED on first reading by a vote of 7 to 0 , this
13th day of September , 1982; ordered published in full in a newspaper of
general circulation in the City of Wheat Ridge and Public Hearing and consideration
on final passage set for October 11 , 1982, 7:30 p.m., in the Council Chambers,
7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a vote of 8
to 0 this 11th day of October 1982.
