ORDINANCE NO. 512
Series of 1982
TITLE: AN ORDINANCE REPEALING AND REENACTING SECTIONS 17-1 AND
17-2 OF THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE,
ADOPTING BY REFERENCE THE UNIFORM PLUMBING CODE, 1982
EDITION, PROVIDING FOR CERTAIN AMENDMENTS THERETO, AND
PROVIDING PENALTIES FOR VIOLATION THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO:
Section 1. Section 17-1 of the Code of Laws of the City of Wheat
Ridge is hereby repealed and reenacted as follows:
The Uniform Plumbing Code by the International Association
of Plumbing and Mechanical Officials is hereby adopted by
reference and incorporated into this article as though fully set
forth herein as the UPC Plumbing Code of the City of Wheat Ridge.
Three (3) copies of said UPC Plumbing Code shall be filed in the
office of the City Clerk and may be inspected during regular
business hours. Except as otherwise provided hereafter, such
Code is adopted in full, including the outline of contents and
index contained therein.
Section 2. Section 17-2 of the Code of Laws of the City of Wheat
Ridge is hereby repealed and reenacted as follows:
"Section 17-2. Amendments. The "Uniform Plumbing Code"
1982 edition, adopted by Section 17-1 hereof is hereby
amended as follows (section numbers referred to herein refer
to and correspond with the section numbers of the Uniform
Plumbing Code):
(a) Section 20.7. Permit Fees. Delete the schedule of
fees and in its place the following sentences shall be
added:
"Any person desiring a permit required by this Code, shall,
at the time of filing an application therefor, pay a fee to
the City Treasurer. Permit fees shall be as established by
Ordinance."
(b) Section 20.14. Board of Appeals. This section shall
be deleted and in its place the following sentences shall be
added:
"In order to determine the suitability of alternate
materials and methods of installation, and provide
reasonable interpretation of the provisions of this Code,
The Building Code Advisory Committee previously established
by Chapter 5 of the Code of Laws of the City, shall have
authority to hear and decide those matters delegated to it,
and all matters requiring use of a Board of Appeals by this
Plumbing Code."
Section 3. Any provision of the Code of Laws of the City of
Wheat Ridge which is inconsistent with or contrary to any of the
provisions hereof is expressly repealed hereby.
Section 4. Violation and Penalties. Any person, firm,
association, or other entity doing any act or omission in
violation of this Code hereby enacted shall be guilty of a
misdemeanor and, upon conviction thereof, shall be subject to a
fine not to exceed $300.00, imprisonment not to exceed 90 days,
or both such fine and imprisonment.

Section 5. Safety Clause. The City Council hereby finds,
determines and declares that this ordinance is promulgated under
the police power of the City of Wheat Ridge; that it is
promulgated for the health, safety and welfare of the public, and
that this ordinance is necessary for the preservation of health
and safety for the protection of public convenience and welfare.
The City Council further determines that the ordinance bears a
rational relation to these objectives.
Section 6. Severability. If any clause, sentence, paragraph or
part of this ordinance or the application thereof to any person
or circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 7. This ordinance will take effect 1 day after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8
to 0 this 27th day of September , 1982; ordered published in
full in a newspaper of general circulation in the City of Wheat
Ridge and Public Hearing and consideration on final passage set
for October 11 , 1982, at 7:30 o'clock p.m., at Council
Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED, AND ORDERED PUBLISHED on second and final reading
by a vote of 8 to 0, this 11th day of October , 1982.
