ORDINANCE NO. 518

TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM AGRICULTURAL-ONE
(A-1) TO PLANNED COMMERCIAL DEVELOPMENT (PCD) AND APPROVAL OF A COMBINED
OUTLINE AND FINAL DEVELOPMENT PLAN AND PLAT ON LAND LOCATED AT
APPROXIMATELY 4880 ROBB STREET, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON,
STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon application of Five K Investment Company for approval of rezoning
and a combined Outline and Final Development Plan and Plat in Wheat Ridge,
Colorado, Case No. WZ-82-2 and based upon recommendation for approval from the
Wheat Ridge Planning Commission and pursuant to findings made based on testimony
and evidence presented at public hearing before the Wheat Ridge City Council,
Wheat Ridge maps are hereby amended to exclude from the Agricultural-One District
and to include in the Planned Commercial Development District, and also does
approve a combined Preliminary and Final Development Plan on the following
described land:
BEGINNING AT THE NORTHWEST CORNER OF THE SOUTH 1/2 OF THE SOUTHEAST
1/4 OF THE SOUTHWEST 1/4, SOUTHWEST 1/4 OF SECTION 16, T3S, R69W
OF THE 6TH P.M.; THENCE RUNNING NORTH 328.7 FEET ALONG THE WEST LINE
OF SAID SOUTHEAST 1/4 TO THE SOUTHWEST CORNER OF NORTHEAST 1/4,
SOUTHWEST 1/4, SOUTHWEST 1/4, THE TRUE POINT OF BEGINNING; THENCE
CONTINUING NORTH 227.8 FEET ALONG THE WEST LINE OF SAID NORTHEAST
1/4; THENCE EAST 662.7 FEET TO A POINT ON THE EAST LINE OF SAID
NORTHEAST 1/4; THENCE SOUTH 228.0 FEET ALONG THE EAST LINE OF SAID
NORTHEAST 1/4 TO THE SOUTHEAST CORNER OF SAID NORTHEAST 1/4; THENCE
WEST 662.6 FEET ALONG THE SOUTH LINE OF SAID NORTHEAST 1/4 TO THE
SOUTHWEST CORNER OF NORTHEAST 1/4, SOUTHWEST 1/4, SOUTHWEST 1/4, THE
TRUE POINT OF BEGINNING; SUBJECT TO THAT PORTION THEREOF BEING IN
ROBB STREET.
Section 2. Safety Clause. The City Council hereby finds, determines, and
declares that this ordinance is promulgated under the general police power
of the City of Wheat Ridge, that it is promulgated for the health, safety, and
welfare of the public, and that this ordinance is necessary for the preservation
of health and safety and for the protection of public convenience and welfare.
The City Council further determines that the ordinance bears a rational relation
to the proper legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall for any
reason be adjudged by a court of competent jurisdiction invalid, such judgment
shall not affect, impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on this
13th day of December , 1982; ordered published in full in a newspaper
of general circulation in the City of Wheat Ridge and Public Hearing and consideration
on final passage set for January 10 , 1983, at 7:30 o'clock p.m., in the
Council Chambers, 7500 West 29th Avenue; Wheat Ridge, Colorado.
Continued to January 24, 1983 at Council Meeting of January 10, by vote of 3 to 0.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a vote of 6
to _ 2 , this _24th day of lan„arY , 1983.
