TITLE: AN ORDINANCE REPEALING AND REENACTING SECTION
2-24(h), 2-24(i), 2-24(j), AND 2-24(k) OF THE
CODE OF LAWS OF THE CITY OF WHEAT RIDGE FOR THE
PURPOSE OF RENUMBERING SAID SECTIONS, SAID
SECTIONS RELATING TO MINOR SUBDIVISION PLATS,
AND PUBLIC HEARINGS ON SPECIAL USE PERMITS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT
RIDGE, COLORADO:
Section 1. Section 2-24(h), 2-24(i), 2-24(j), and 2-24(k)
of the Code of Laws of the City of Wheat Ridge is hereby
repealed and reenacted as follows:
"(I) Minor subdivision plats without public street
dedications or public reservations shall be heard and
approved by the planning commission at a public
hearing. Public hearings shall be conducted following
procedures outlined in the subdivision regulations.
(J) Minor subdivision plats with public street
dedications or public reservations shall be heard by
the planning commission at a public hearing and shall
then be forwarded with their recommendations to city
council for final approval. Public hearings shall be
conducted following procedures outlined in the
subdivision regulations.
(K) Wherein the planning commission has denied a
minor subdivision, an applicant may appeal that decision
to city council in accordance with paragraph (d) of
this section. Wherein the planning commission has
approved such a minor subdivision, aggrieved adjacent
property owners may appeal that decision to city
council in accordance with paragraph (d) of this
section.
(H) Public hearings shall be held for special use
permits, which approve specific land uses following the
procedures for changes of the zoning map. The planning
commission shall make a recommendation to the city
council and the final action shall be taken by the city
council following the procedures for changes to the
zoning map."
Section 2. Severability. If any clause, sentence, paragraph,
or part of this ordinance or the application thereof to any
person or circumstances shall for any reason be adjudged by
a court of competent jurisdiction invalid, such judgment
shall not affect, impair, or invalidate the remainder of
this ordinance or its application to other persons or cir-
cumstances.
Section 3. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated
under the general police power of the City of Wheat Ridge,
that it is promulgated for the health, safety, and welfare
of the public, and that this ordinance is necessary for the
preservation of health and safety and for the protection of
public convenience and welfare. The City Council further
determines that the ordinance bears a rational relation to
the proper legislative object sought to be attained.

Section 4. This ordinance shall take effect 15 day(s)
after final publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of
- 5 to 0 on this 14th day of February , 1983;
ordered published in full in a newspaper of general circulation
in the City of Wheat Ridge and Public Hearing and consideration
on final passage set for Februa 28 , 1983, at
7:30 p.m., in the Council Chambers, X500 West 29th Avenue,
Wheat Ridge, Colorado.
READ, ADOPTED, AND ORDERED PUBLISHED on second and final
reading by a vote of _7 to 0 this 28th day of
