HomeMy WebLinkAboutOrdinance-1983-0523INTRODUCED BY COUNCILMEMBER Aiello ORDINANCE NO. 523 Series of 1983 TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A CHANGE OF ZONING CONDITIONS ON COMMERCIAL-ONE ZONED LAND LOCATED AT APPROXIMATELY 3901 WADSWORTH BOULEVARD AND 7615 WEST 39TH AVENUE, WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, THAT: Section 1. Upon application by Benedict Pisciotta for approval of a change of zoning conditions in Wheat Ridge, Colorado, Case No. WZ-82-16, and based upon recommendation for approval from the Wheat Ridge Planning Commission and pursuant to findings made based on testimony and evidence presented at public hearing before the Wheat Ridge City Council, the conditions which were applied to this site by adoption of Ordinance No. 383 are hereby repealed and are replaced by the conditions stipulated in Section 2 below. The subject property is legally described as follows: PARCEL A: Beginning at a point 25 feet North of the SE corner of the NE'; of the SE'; of the SW4 of Section 23, T3S, R69W; thence I-Jest 115 feet; thence North 108 feet; thence East 115 feet; thence South 108 feet to the point of beginning, except the East 30 feet thereof that lie in Wadsworth Boulevard, and except that portion of the above described tract described in Book 1179 at Page 586, and also except an easement along the Northerly 10 feet of said property for sewer, water and gas utilities as now installed to serve property adjoining the West line of said property. PARCEL B: The West 65 feet of that part of the NE14, SE-1, SW, of Section 23, T3S, R69W of the 6th P.M., described as follows: Beginning at a point 25 feet North of the SE corner of the NE4, SE'-;, SW-1, of said Section; thence West 180 feet; thence North 108 feet; thence East, 180 feet; thence South 108 feet to the point of beginning. Section 2. Conditions. The permitted uses within the Commercial-One (C-1) Zone District for the parcels described above are conditioned as follows: That all street related imrpovements be installed along West ]9th Avenue and Wadsworth Boulevard when building permits are applied for. 2. That the turn lane on Wadsworth Boulevard be extended south to West 39th Avenue with dedication of 17 feet for right-of-way, Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. Severability If any clause, sentence, paragraph, or part of this Ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 5. This Ordinance shall take effect 15 days after final publication.
