ORDINANCE NO. 531

TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM RESIDENTIAL-
TWO (R-2) AND AGRICULTURAL-ONE (A-1) TO PLANNED RESIDENTIAL DEVELOPMENT
(PRD) AND APPROVAL OF A COMBINED OUTLINE AND FINAL DEVELOPMENT PLAN AND
PLAT ON LAND LOCATED AT APPROXIMATELY 5001 GARRISON STREET, CITY OF
WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon application of Warren Cruise,et al, for approval of rezoning
and a combined Outline and Final Development Plan and Plat in Wheat Ridge,
Colorado, Case No. WZ-83-6 and based upon recommendation for approval from the
Wheat Ridge Planning Commission and pursuant to findings made based on testimony
and evidence presented at public hearing before the Wheat Ridge City Council,
Wheat Ridge maps are hereby amended to exclude from the Residential-Two (R-2)
and Agricultural-One (A-1) and to include in the Planned Residential Development
(PRO) District, and also does approve & combined Outline and Final Development
Plan and Plat on the following described land:
A part of the Southwest one-quarter of Section 15, Township 3 South,
Range 69 West of the 6th P.M., and a part of Independence Business
Park, City of Wheat Ridge, County of Jefferson, State of Colorado,
more particularly described as follows-
Beginning at the Northeast corner of the Southeast one-quarter of
the Southwest one-quarter of said Section 15; thence South O°01'35"
West along the East line of said Southwest one-quarter 329.57 feet;
thence South 39°53'37" West 30.00 feet; thence South 0°01'35" West,
parallel with the East line of said Southwest one-quarter 299.56 feet
to a point on the Northerly right-of-way line of West 49th Avenue;
thence South 89°53'39" West 150.00 feet; thence North 0°01'35" East
299.56 feet; thence South 89°53'37" West 480.60 feet to a point on
the West line of the Northeast one-quarter of the Southeast one-quarter
of said Southwest one-quarter; thence North 0000'59" West along said
West line 329.56 feet to the Southwest corner of Lot 4 of said Independence
Business Park (Boundary Corner No. 2); thence North 0°01'20" East 319.00
feet to the Northwest corner of Lot 3 of said Independence Business Park
(Boundary Corner No. 10); thence North 0000'30" West along the boundary
of said Independence Business Park 134.27 feet to a point on the South
line of a 100 foot wide Public Service Company right-of-way (Boundary
Corner No. 9 of Independence Business Park); thence on an angle to the
right of 78°34'51" and Easterly along said South line and along a curve
to the right having a radius of 5686.88 feet, a central angle of 6°43'45"
and an arc length of 667.88 feet to a point on the East line of the
Southwest one-quarter of said Section 15; thence South 0°01'00" West
along said East line 248.01 feet to Boundary Corner No. 13 of said
Independence Business Park; thence on an angle to the right of 85°04'12"
and Westerly along a curve to the left havinq a radius of 5439.75 feet,
a central angle of 0°06'20" and an arc length of 10.04 feet to a point
on the Westerly right-of-way line of Garrison Street; thence on an angle
to the left of 84°57'52" and South 0°01'00" West along said Westerly
right-of-way line 104.20 feet; thence South 89°59'00" East 10.00 feet
to a point on the East line of the Southwest one-quarter of said Section
15, said point also being Boundary Corner No. 14 of said Independence
Business Park; thence South 0°01'00" West along the East line of said
Southwest one-quarter 192.58 feet to the Point of Beginning, containing
13.6838 acres more or less.
Section 2. Safety Clause. The City Council hereby finds, determines, and declares
that this ordinance is promulgated under the general police power of the City of
Wheat Ridge, that it is promulgated for the health, safety, and welfare of the
public, and that this ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare. The City Council
further determines that the ordinance bears a rational relation to the proper
legislative object sought to be attained.

Section 3. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall for
any reason be adjudged by a court of competent jurisdiction invalid, such
judgment shall not affect, impair or invalidate the remainder of this ordinance
or its application to other persons or circumstances.
Section 4. This ordinance shall take effect 1 day after final publication.
