TITLE: AN ORDINANCE AMENDING VARIOUS SECTIONS OF APPENDIX A, ZONING
ORDINANCE, OF THE CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF
COLORADO, RELATING TO RESIDENTIAL GROUP HOMES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, THAT:
Section 1. Wheat Ridge Code of Laws, Appendix A, Section 4, Residential-one
District, A. Use Regulations, is hereby amended by the addition of a new
subsection 11 to read as follows:
"11. Residential Group Home for Eight or Fewer CHILDREN OR ELDERLY PERSONS
This is a residential facility, licensed by the appropriate state or local
agencies, which provides shelter, care, and/or staff supervision for not more
than eight CHILDREN OR ELDERLY PERSONS INCLUDING THOSE CHILDREN OR ELDERLY
PERSONS RELATED OR TO THE CARETAKERS WHO PERMANENTLY RESIDE IN THE HOME, PLUS
THE CARETAKER and additional required staff. A Residential Group Home shall
maintain a minimum lot area of 1,500 square feet for each CHILD OR ELDERLY
PERSON residing at the home; shall be located no closer than 750' from
another residential group home, or group home for the developmentally
disabled; shall provide view obscuring screening of any additional structure,
such as a trash dumpster or playground equipment associated with the group
home which is inconsistent with the character of the surrounding neighborhood.
Section 2: Wheat Ridge Code of Laws, Appendix A, Section 4, Residential One
District, B. Special Uses, is hereby amended by the addition of a new
subsection 2 to read as follows:
"2. Residential Group Home for Nine or More CHILDREN OR ELDERLY PERSONS
This is a residential facility licensed by the appropriate State and/or local
agency which provides shelter, care, and/or staff supervision for 9 or more
CHILDREN OR ELDERLY PERSONS, INCLUDING THOSE CHILDREN OR ELDERLY PERSONS
RELATED TO THE CARETAKERS WHO PERMANENTLY RESIDE IN THE HOME, PLUS THE
CARETAKER and additional required staff. A residential Group Home shall
maintain a minimum lot area of 1,500 square feet for each CHILD OR ELDERLY
PERSON residing at the facility; shall be located no closer than 750 feet
from another residential group home,. or group home for the developmentally
disabled; shall provide screening of any additional structure, such as trash
dumpster or playground equipment associated with the group home which is
inconsistent with the character of the surrounding neighborhood.
In order to assess a proposed Residential Group Home facility, the following
information shall be submitted by the applicant and used by PlanningCommission
and City Council in considering approval of a Special Use Permit.
1. A Site Plan of the site indicating location and extent of all existing and
proposed buildings; parking and circulation areas; landscaping and
buffering, fences, wall, etc.; recreational facilities and open space;
outdoor lighting facilities; trash receptacles; or any other physical
features that might help identify the expected character of the proposed
facility.
2 A LETTER FROM THE AGENCY LICENSING THE FACILITY WITH THE FOLLOWING
INFORMATION
a THE. FACT THAT THE AGENCY HAS LICENSED OR IS PREPARING TO LICENSE
THE FACILITY,
b. Special Needs of the residents, such as on-site schooling or training,
and any facilities needed to meet such special needs.
c THE NUMBER OF CHILDREN OR ELDERLY PERSONS FOR WHOM THE LICENSE IS
BEING ISSUED
d. IN THE CASE OF CHILDREN, THE APPROXIMATE AGES OF THE CHILDREN.
Section 3: Wheat Ridge Code of Laws, Appendix A, Section 5, Residential One-A

District, A. Use Regulations, is hereby amended by the addition of a new
subsection 11. to read as follows:
"11. Residential Group Home for EIGHT or Fewer CHILDREN OR ELDERLY
PERSONS This is a residential facility, licensed by the appropriate state and
local agencies, which provides shelter, care, and/or staff supervision for not
more than eight CHILDREN OR ELDERLY PERSONS, INCLUDING THOSE CHILDREN OR
ELDERLY PERSONS RELATED TO THE CARETAKERS WHO PERMANENTLY RESIDE INTHE HOME,
PLUS THE CARETAKER and additional required staff. A Residential Group Home
shall maintain a minimum lot area of 1,500 square feet for each CHILD OR
ELDERLY PERSON residing at the home; shall be located no closer than 750'
from another residential group home, or group home for the developmentally
disabled; shall provide view obscuring screening of any additional structure,
such as trash dumpster or playground equipment associated with the group home
which is inconsistent with the character of the neighborhood.
Section 18. Wheat Ridge Code of Laws, Appendix A. Section 14, Agricultural-one
District, B. Special Uses, is hereby amended by the addition of a new
subsection 2. to read as follows:
"2. Residential Group Home for NINE or More CHILDREN OR ELDERLY
PERSONS: This is a residential facility, licensed by the appropriate State
and/or local agencies, which provides shelter, care, and/or staff supervision
for nine or more CHILDREN OR ELDERLY PERSONS, INCLUDING THOSE CHILDREN OR
ELDERLY PERSONS RELATED TO THE CARETAKERS WHO PERMANENTLY RESIDE IN THE HOME,
PLUS THE CARETAKER and additional required staff. A residential group home
shall maintain a minimum lot area of 1,500 square feet for each CHILD OR
ELDERLY PERSON residing in the facility; shall be located no closer than
750 feet from another residential group home or home for the developmentally
disabled; shall provide screening of an additional structure, such as trash
dumpster or playground equipment associated with the group home which is
inconsistent with the character of the surrounding neighborhood. In order
to adequately assess a proposed Residential Group Home facility, the following
information shall be submitted by the applicant and used by Planning
Commission and City Council in considering approval of a Special Use Permit.
1. A Site Plan of the site indicating location and extent of all existing and
proposed buildings; parking and circulation areas; landscaping and
buffering, fences, wall, etc; recreational facilities and open space;
outdoor lighting facilities; trash receptacles; or any other physical
features that might help identify the expected character of the proposed
facility.
2. A LETTER FROM THE AGENCY LICENSING THE FACILITY WITH THE FOLLOWING
INFORMATION.

Section 23: Wheat Ridge Code of Laws, Appendix A, Section 28. Definitions, is
hereby amended by the addition of a new subsection 44a. to read as follows:
44.a. RESIDENTIAL GROUP HOME: THIS TERM INCLUDES BOTH GROUP HOMES FOR CHILDREN
AND GROUP HOMES FOR ELDERLY PERSONS AS DESCRIBED BELOW. FOR THE PURPOSE OF
THIS DEFINITION, A RESIDENTIAL GROUP HOME IS THE USE OF A SITE WHICH IS UNDER
SINGLE OWNERSHIP, CONTROL, MANAGEMENT, AND/OR LICENSE, AND WHICH MAY BE
CONTAINED IN A SINGLE STRUCTURE, OR A GROUP OR COMPLEX OF BUILDINGS.
GROUP HOMES FOR CHILDREN: THESE ARE RESIDENTIAL FACILITIES WHICH ARE
LICENSED BY A GOVERNMENTAL CHILD PLACEMENT AGENCY OR AUTHORITY FOR
THE PURPOSE OF PROVIDING UP TO 24-HOUR CARE, SUPERVISION, AND/OR
TRAINING FOR CHILDREN UNDER THE AGE OF 18 YEARS. THOSE CHILDREN
PLACID IN A HOME UNDER THE AGE OF 18 BUT WHO REMAIN IN THE HOME
AFTER REACHING THE AGE OF 18 SHALL BE CONSIDERED A CHILD UNDER THIS
DEFINITION UNTIL REACHING THE AGE OF 21. GROUP HOMES FOR CHILDREN
INCLUDE, BUT ARE NOT LIMITED TO THE FOLLOWING TYPES OF LICENSED
FACILITIES: FAMILY FOSTER HOMES, SPECIALIZED GROUP HOMES OR GROUP
CENTERS, RESIDENTIAL CHILD CARE FACILITIES AND CRISIS CENTERS.
GROUP HOMES FOR THE ELDERLY: A group home which is either owner-occupied,
TENANT OCCUPIED, OR occupied by a non-profit group for the use of persons, 60
years of age or older, who do not need on-site professional health care
facilities or staff. THE HOME MAY BE OPERATED BY, OR EMPLOY PERSONS WHO
PROVIDE OTHER SERVICES SUCH AS MEALS AND CLEANING, BUT NOT PHYSICAL OR HEALTH
CARE.
Section 24: Safety Clause. The City Council hereby finds, determines, and
declares that this ordinance is promulgated under the general police power of
the City of Wheat Ridge; that it is promulgated for the health, safety and
welfare of the public, and that this ordinance is necessary for the
preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a
rational relation to these objectives.
Section 25: Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall
for any reason be adjudged by a court of competent jurisdiction invalid, such
judgement shall not affect, impair or invalidate the remainder of this
ordinance or its application to other persons or circumstances.
Section 26: This Ordinance shall take effect 15
publication.
