ORDINANCE N0. 539
TITLE: AN ORDINANCE PROVIDING FOR THE REZONING OF LAND FROM AGRICULTURAL-ONE
(A-1) TO COMMERCIAL-ONE (C-1) ON PROPERTY LOCATED AT APPROXIMATELY
10110 SOUTH I-70 SERVICE ROAD, CITY OF WHEAT RIDGE, COUNTY OF
JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1: Upon application by the City of Wheat Ridge for approval of
rezoning in Wheat Ridge, Case No. WZ-83-15, and upon recommendation for
approval from the Wheat Ridge Planning Commission, and pursuant to findings
made based upon testimony and evidence present at public hearing before the
Wheat Ridge City Council, Wheat Ridge Maps are hereby amended to exclude from
the Agricultural-One (A-1) and to include within the Commercial-One (C-1) Zone
District, the following described land:
A parcel of land located in the northeast 1/4 of Section 21
and the southeast 1/4 of Section 16, Township 3 South,
Range 69 West of the 6th P.M., Jefferson County, Colorado,
described as follows: Commencing at the northwest corner
of the northeast 1/4 of the northeast 1/4 of the northeast
1/4 of Section 21, thence S0024130"E a distance of 30
feet to the point of beginning; thence N45029'45"W a
distance of 82.6 feet; thence S77034'45"E a distance of
477.5 feet; thence S83055'00"E a distance of 88.3 feet; thence N890
38'00"E a distance of 13.92 feet; thence S0022100"E
a distance of 55 feet; thence S89038'00"W a distance of
13.92 feet; thence N77034'45"W a distance of 507.5 feet to
the point of beginning.
Section 2: Safety Clause: The City Council hereby finds, determines, and de-
clares that this ordinance is promulgated under the general police power of
the City of Wheat Ridge, that it is promulgated for the health, safety, and
welfare of the public, and that this ordinance is necessary for the presev-
ation of health and safety and for the protection of public convenience and
welare. The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall
for any reason be adjudged by a court of competent jurisdiction invalid, such
judgment shall not affect, impair or invalidate the remainder of this
ordinance or its application to other persons or circumstances.
Section 4. This ordinance shall take effect 01 day after final publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on this
13th day of June , 1983; ordered published in full in a newspaper of
general circulation in the City of Wheat Ridge, and Public Hearing and
consideration on final passage set for July 18 1983, at 7:30 o'clock
p.m., in Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.

5 to 3 this 18thQ 1 , 1983.
