TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
AGRICULTURAL-ONE (A-1) TO COMMERCIAL-ONE (C-1) ON LAND LOCATED AT 9605
WEST 49TH AVENUE, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF
COLORADO
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon application by Edwin and Barbara Owings for approval of
rezoning in Wheat Ridge, Colorado, Case No. WZ-83-11 and based upon
recommendation for approval from the Wheat Ridge Planning Commission and
pursuant to findings made based on testimony and evidence presented at public
hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby
amended to exclude from the Agricultural-One and to include in the
Commercial-One District, the following described land:
A parcel of land located in the North 1/2 of the Southwest 1/4 of
Section 15, Township 3 South, Range 69 West of the 6th P.M., Jefferson
County, Colorado, more particularly described as follows:
Commencing at the Southeast corner of said North 1/2 of the
Southwest 1/4 of the Southwest 1/4 of Section 15; thence N 00
degrees 03' 29" W along the East line of said North 1/2 of the
Southwest 1/4 of the Southwest 1/4 a distance of 142 feet, thence S
89 degrees 46' 17" W a distance of 25 feet to the Southeast corner
of Lot 3, KIPLING 5000 BUSINESS PARK, as recorded in Reception No.
78070379 of the records of said Jefferson County, said point also
being the Point of Beginning, thence S 89 degrees 46' 17" W along
the South line of said Lot 3 a distance of 113.0 feet to the
Northeast corner of Lot4, KIPLING 5000 BUSINESS PARK; thence S 00
degrees 03' 29' E along the East line of said Lot 4 a distance of
112.0 feet to the Southeast corner of said Lot 4 also the North
line of West 49th Avenue as described in Reception No. 81066887;
thence N 89degrees 46' 17" E along said North line and parallel to
the South line of the North 1/2 of the Southwest 1/4 of the
Southwest 1/4 a distance of 92.0 feet; thence N 54 degrees 20' 17'
E continuing along said North line a distance o25.85 feet to the
West line of Independence Street as described in Book 742 at Page
230; thence N 00 degrees 03' 29" W along said West line and
parallel to the East line of the North 1/4 of the Southwest 1/4 of
the Southwest 1/4 a distance of 97.03 feet to the Point of
Beginning, containing 0.286 acres more or less.
Section 2: Conditions:
1. Before any change in use or before building permits are issued, an official
Development Plan must be submitted that would be compatible with the
surrounding land uses and architectural design.
2. The Official Development Plan is to come before the Planning Commission and
City Council for Public Hearings prior to any change of use or building
permits being issued.
Section 3. Safety Clause. The City Council hereby finds, determines, and
declares that this ordinance is promulgated under the general police power of
the City of Wheat Ridge, that it is promulgated for the health, safety, and
welfare of the public, and that this ordinance is necessary for the
preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be attained,
Section 4. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall for
any reason be adjudged by a court of competent jurisdiction invalid, such
judgment shall not affect, impair or invalidate the remainder of this ordinance
or its application to other persons or circumstances.
Section 5. This ordinance shall take effect 15 days after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 7 to 0 _ on
this 27th day of June 1983, ordered published in full in a
newspaper of general circulation in the City of Wheat Ridge and Public Hearing
and consideration on final passage set for July 25 _ , 1983, at 7:30
o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge,
Colorado.
READ, ADOPTED A24D ORDERED PUBLISHED on second and final reading by a vote of
8 to 0 , this 25th day of July 1983.
