HomeMy WebLinkAboutOrdinance-1983-0547INTRODUCED BY COUNCILMEMBER Ore ORDINANCE NO. 547 Series of 1983 TITLE: AN ORDINANCE PROVIDING FOR THE REZONING OF LAND FROM AGRICULTURAL-TWO (A-2) AND COMMERCIAL-TWO (C-2) TO PLANNED INDUSTRIAL DEVELOPMENT (PID) AND APPROVAL OF AN OUTLINE DEVELOPMENT PLAN ON PROPERTY LOCATED AT APPROXIMATELY 5060 WARD ROAD, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT Section 1. Upon application by Jolly Rancher Candies and Liquified Sweetners, LSI Corporation, for approval of rezoning in Wheat Ridge, Case No. WZ-83- 5, and upon recommendation for approval from the Wheat Ridge Planning Commission, and pursuant to findings made based upon testimony and evidence presented at public hearing before the Wheat Ridge City Council, Wheat Ridge Maps are hereby amended to exclude from the Agricultural-Two (A-2) and Commercial-Two (C-2) and to include within the Planned Industrial District and approve an Outline Development Plan on the following described land: BEATRICE FOOD COMPANY PROPERTY: A tract of land located in Lots 17 and 13, Standley Heights, a subdivision recorded in the official records of Jefferson County, Colorado, described as follows: Beginning at the Southwest corner of said Lot 17; thence NO004.2'W along the West line of said Lot 17 a distance of 25.00 feet to a point on the North line of West 50th Place as conveyed to Jefferson County by instruments recorded in Book 987 at Page 407 and 409 of said Official Records, said point being a True Point of Beginning; thence N88°59.0'E along the North line of West 50th Place as recorded in said Book 987 at Pages 407 and 409 a distance of 1036.24 feet to the Northeast corner of West 50th Place as recorded in said Book 987 at Pages 407 and 409; Section 2. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 4. This ordinance shall take effect 15 days after final publication. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on this 25th day of July , 1983, ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for August 22 , 1983, at 7:30 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
