HomeMy WebLinkAbout03/08/1973 MINUTES March 8, 1973 The one hundred and ninety-fourth regular meeting of the Wheat Ridge City Council was called to order at 7 35 p.m. at 7390 West 38 Avenue by Mayor Albert E Anderson. Aldermen attending were Joseph Donaldson, Robert Howard, Calvin Hulsey and Ray Pepe. Alderman Abramson was absent, and the sixth seat is vacant pending an appointment by Council. Others attentind were Mayor Anderson, City Clerk Louise F. Turner, Citv Attornev Maurice Fox, staff personnel, and approximately 50 interested citizens. Citizen Comments were made by Mrs Pete Scoma of 2855 Gray who presented petitions containing 241 names of residents in the area from Sheridan Blvd. to Harlan Street and 26 Avenue to 29 Avenue, who were requesting a rezoning from their present district to one which will allow single family homes and not allow multiple units. Homer L. Pearson of 4015 Balsam Street who stated he had given petitions to the City Clerk during the afternoon to be given to Council. He said the petitions contained 781 names of people supporting Ronald Davis for the Council vacancy and asked that Council vote so that this area would not continue to be short a half vote. In answer to a question from Alderman Pepe he said passing of the petitions was not done by ~he Chamber of Commerce but by rruividuals. Council made comments on the pressures that had been placed on them, the appointment and reasons for the delay in making the appointment Dora Pi coli presented to the Mayor, a letter from Mary Estill Buchanan of the Colorado Commission on the Status of Women recommending the appointment of a woman to Council. The letter is attached to the Minutes. Harry Boorman, manager of the Wheat Ridge Chamber of Commerce who said passing of the petitions for Mr. Ron Davis had not been a Chamber of Commerce activity. The petitions are filed in the General File. Mayor Anderson read a Proclamation proclaiming that March 11 through 18, 1973 be "International De Molay Week in Wheat Ridge." He presented the Proclamation to David ~raft, ~irk Searle, Tim Turner and Jim Warren who were members of De Molay. Transfer of stock of Caravan West Inc. to Dale Long of 12050 West Dakota Drive in Lakewood was considered. Application papers were found to be in order and Mr. Long and Mr. and Mrs. Merretig, the new officers of Caravan West Inc. were present. No one else appeared, either in favor or in opposition. Motion by Alderman Hulsey "I move we approve the transfer of stock of Caravan West at 11221 West 44 Avenue." Motion was seconded by Alderman Pepe and passed 4-0. A Preliminary Hearinq for Denver Inn West Inc. dba The Red Carpet Inn to be located at 10101 West 1-70 Service Road north was held. Attorney Michael Villano appeared on behalf of the applicant. Motion by Alderman Pepe "I move that a Public Hearing for Denver Inn West Inc. dba Red Carpet Inn be set for April 26, 1973 at 7 30 p.m. in these chambers, and that a neighborhood be set at a one mile radius subject to change in accordance with evidence presented at the hearing" Motion was seconded by Alderman Hulsey and passed 4-0. MINUTES - March B, 1973 - Continued -2- Mavor Anderson stated that two items on theo Agenda - a requ7st by 5afeway for a transfer of location of a 3.2% beer package llcense and a rezoning hearing for Holt-Chew would not be heard. David C. Deuben, attorney of 4315 Wadsworth representing Brannan Sand and Gravel asked that Case WE-72-02 be tabled until matters of interest to both Brannan and the Parks Department could be worked out. WZ-72-38 Rezoninq Case was heard. Application of Ramona 50ucie requested a change from Residential-One to Residential-One-A at 3200-3500 Quail. Robert Barr, Acting Planning Director said 1. The Planning Commission had recommended approval by a vote of 2-1 for the following reasons a. It would be a downgrading, but would be a proper use. b. It would not place an undue burden on schools, nor cause an appreciable increase in traffic, and c. It was not likely to develop as Residential-One because of the proximity of a school and of church property. 2. That an area of 4.89 acres was involved. 3 That property to the east was R-1-A and was partly houses and partly school ground 4. Property to the south was houses, was in Lakewood and he thought it was zoned Residential-One, and it would be checked before the next meeting on request of Alderman Pepe. 5. The property to the north and northeast was Residential-One and undeveloped. 5. The property to the west was an open area belonging to Applewood Baptist Church. 7. Residential-One required 100 foot frontage and 12,500 square feet and would allow 13 houses, and Residential-One-A required 75 foot frontage and 9,000 square feet or 9,600 square feet on a corner and would allow 15 houses or more. 8. There was a 12 to 13 foot strip on the east side the full north- south distance which was a drainage easement, the status of which was unknown, if added to the property would not change the number of units appreciably. 9 That area was in Brookside Subdivision and ROW could be acquired at the time of platting. Ralph Jacobson of 2150 Kendrick in Golden of SJS Company stated his company had purchased the property and now owned it as trustee, appeared as owner and presented the request for change. Mr. Jacobson stated 1. That two people had appeared at the Planning Commission Meeting in opposition. 2 That Lena Gulch was on the north. 3. That property to the east and south is higher and 400 homes drain into this property. 4. That Lane Engineering had engineered Applewood Knolls and had been retained regarding this property, and a written report had been submitted. This report was presented to Council and is attached to the Minutes. 5. That the area to the south in Lakewood was Residential-One_A Zoning. 6 That to the west was church property, and in his experience, people living in Residential-One zoning preferred not to be near a church, and that the church intended to retain a 10 acre tract there for church purposes. 7 On the south half of the east side were six lots, four of which had Residential-One-A houses built on them. 8. The balance of the east side bordered a school. 9. That there were six single family homes on 32 Avenue between Quail Street and Simms Street and one was to come down, and that ~orth across the gulch were multiples." 10 Houses to be built would have four bedrooms and two-car garages, had been designed for lots with 75 feet for frontage. No one appeared in opposition and no one appeared in favor. MINUTES - March B, 1973 - Continued -3- Motion by Alderman Pepe. "I move that Case WZ-72-3B be taken under advisement for one week for a decision to be rendered in these chambers at. 7 3D pm." Motion was seconded by Alderman Hulsey and passed 4-0. Dwaine R. Richter of 2560 Berry Lane, Golden presented to Council a petition for annexation of propertv north of 32 Avenue and immediately west of 1-70 He stated that a request for simultaneous rezoning had been submitted to the Planning Department. Citv Attornev Maurice Fox stated that after the rezoning request had been heard by the Planning Commission, the rezoning and the annexation would be heard together by the Council Motion by Alderman Donaldson "I move that a hearing be tentatively set for 7 30 p.m. on April 12, 1973 in these chambers.fl Motion was seconded by Alderman Howard and passed 4-0. Ordinance No. 124 pertaining to Case WV-72-o6 - alley vacation came up for consideration, having been heard previously on second reading. In answer to a question from Alderman Pepe, Mr. Barr stated that if the alley were vacated, 12 units could be built on the Henckel property Lots 43 and 44, and if it was not vacated 8 units could be built. He added that Mr. Chambers who had opposed the vacation, now favored it. Motion by Alderman Pepe "I move that Ordinance No. 124 pertaining to Case WV-72-o6 vacation of an alley between 27 Avenue and 28 Avenue east of Fenton Street and presented by George Henckel, be defeated on second reading" Motion was seconded by Alderman Donaldson. Alderman Pepe explained that approving the vacation "would be granting higher density in Ward I which is not needed." Motion passed 3-1. Alderman Hulsey voted "nay" and Alderman Abramson was absent. LANE Registered P/Ofe5sIonaJ Engin..r ReQ;stttred L"nd Surveyor TELEPHONE 233-4042 March 8, 1973 COUNCIL MINUTES - MARCH 8, 1973 Mayor and City Council City of Wheat Ridge 7470 West 38th Avenue Wheat Ridge, Colorado 80033 Gentlemen The following brief comments are made relative to the pro- posed residential development on the west side of Quail Street, immediately north of West 32nd Avenue All comments relate to a 10-year storm, except the comment concerning Lena Gulch 1 Lena Gulch is a major water course Engineers report indicate that its not encroach upon this tract The Corps of flood plain does 2 Approximately 165 cu ft sec of flood water will reach the intersection of West 32nd Avenue and Quail Street from the basin lyi~g south and east of this site Because of the inadequacy of facilities at this point, about 135 cfs will enter property, and the remainder will flow west on West 32nd to ap- proximately Robb Circle, and thence north to Lena Gulch 3 This 135 cfs of runoff enters the propose~ develop- ment at its ~outheast corner A drainage ditch presently runs north from this point along the west side of Quail Street for several hundred feet, then discharges into a natural swale running northwesterly to Lena Gulch To better utilize this tract, the drainage will probably be rerouted into an open ditch to the west side of the tract and allowed to discharge in the same swale 4 There are two 18-inch storm drains that enter the property from areas east of Quail Street These drains will be continued westerly through this tract to the proposed drain on the west property line , Mayor and city Council City of Wheat Ridge March 8, 1973 Page 2 5 There are approximately 400 building sites within this drainage basin From these 400 sites, approxi- mately 135 cfs of runoff will reach the proposed development Arithmetically, this is 0 34 cfs per site In the proposed zoning, the number of sites would be 16, while under existing zoning there are 12 Rl sites This net difference of 4 sites will produce an increase of about 1 3 cfs additional runoff, or 1% of the total 6 A complete drainage study will be furnished to the City at the time the Subdivision Plat is pre- pared Very truly yours, LANE ENGINEERING SERVICE .., / 'I ELL gsn /' /IJ.
