HomeMy WebLinkAboutOrdinance-1984-0567INTRODUCED BY COUNCILMEMBER ORDINANCE NO. 567 Series of 1984 MERKL TITLE: AN ORDINANCE REPEALING AND REEANCTING SECTION 15-8(A) OF THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE, RELATING TO FISHING, AND SPECIFYING IN DETAIL THE RULES AND REGULA- TIONS APPLICABLE TO FISHING WITHIN THE CITY OF WHEAT RIDGE, AND PROVIDING A PENALTY FOR VIOLATION THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: Section 1. Section 15-8, Water Areas (A) Fishing of the Code of Laws of the City of Wheat Ridge is hereby repealed and reenacted as follows: "(A) Fishing. (1) License required. It shall be unlawful for any person fifteen (15) years of age and over to fish for fish, crayfish, salamanders, or frogs without a proper and valid Colorado state fishing license on his (her) person. Any person in violation of this provision shall be deemed guilty of trespass. (2) Methods of taking. a. Fish. No fish shall be taken or killed except by the use of hook and line with no more than three hooks attached to any line. (For the purpose of these regulations multiple hooks having a common shank, i.e. treble hooks shall be considered as one hook.) b. Frogs. Permitted methods of taking frogs are by use of hook and line, nets, gigs, or by hand between August 15 and September 30. Artificial lighting may be used. C. Crayfish and salamanders. Crayfish and salamanders may be taken by hand, hook, and line, traps, pots, nets, or seines not to exceed ten feet in length. (3) Second rod stamp. An additional rod may be used in all waters when a Second Rod Stamp is properly signed and attached to the fishing license. (4) Unattended rod. Any rod or line that is used for fishing must be personally attended. (5) Prohibited methods. Snagging (Snatching with hooks, gang hooks, or similar devices to catch fish) archery and spear fishing are prohibited. (6) Chumming. Placing fish, parts of fish, or other material upon which fish might feed in the waters for the purpose of attracting fish to a particular area in order that they may be taken (chumming) is prohibited. (7) Turtles. Taking of turtles is prohibited. (8) Size limit. All largemouth or smallmouth bass (black bass) taken under fifteen inches in length shall be returned to the water immediately. (9) Artificial flies and lures. Fishing in Bass Lake and West Prospect Lake is restricted to the use of artificial flies and artificial lures. (10) Daily possession limits. Any person in possession of a valid fishing license is entitled to the following numbers of fish. Any person under fifteen years of age without a valid fishing license may possess half of these numbers: Largemouth or smallmouth Bass, in aggregate* 6 Channel or Blue Catfish, in aggregate* 10 Sacramento Perch 10 PAGE Two Crappie 20 Bluegill 30 Bullhead 30 Yellow Perch 30 Frogs 10 Crayfish (crawdads) 250 Salamander (aquatic gilled form) 120 (adult land form) 6 *"In aggregate" means the limit may consist of one species or may be a mixed bag of more than one species. (11) Fishing locations. Fishing shall be allowed from the shoreline excluding dock areas and boat launch areas. Fishing from boats if allowed except on Prospect Lane or except where posted as prohibited." Section 2. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preserva- tion of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. Section 4. Any act committed in violation of the provisions hereof shall be considered a misdemeanor and any person so con- victed shall be subject to the penalties as provided in Section 15-4 hereof. Section 5. This ordinance shall take effect 15 day(s) after final publication.
