HomeMy WebLinkAboutOrdinance-1984-0568INTRODUCED BY COUNCT4LMEMBER MERKL ORDINANCE NO. 568 Series of 1984 TITLE: AN ORDINANCE AMENDING CHAPTER 21 OF THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE BY ADDING A SECTION 21-38, ASSIGNMENT OF REFUND TO SENIOR CENTER FUND, PROVIDING FOR THE ABILITY FOR THE RECIPIENT OF A PROPERTY TAX REFUND TO ASSIGN THAT REFUND TO THE SENIOR CENTER FUND MAINTAINED BY THE CITY OF WHEAT RIDGE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: Section 1. Chapter 21 of the Code of Laws of the City of Wheat Ridge is hereby amended by the addition of the following Section 21-38, Assignment of Refund to Senior Center Fund: "Notwithstanding any provision of this Chapter 21 to the contrary, any individual entitled to a refund pursuant to the provisions of Sections 21-28 through 21-37, inclusive hereof, may assign his/her rebate to the Senior Center Fund maintained by the City of Wheat Ridge for use in capital improvements or capital expenditures on the Wheat Ridge Senior Center. No refunds so assigned shall be used for general operations or maintenance of said Senior Center. The City Clerk is hereby empowered and authorized to prepare and main- tain forms sufficient to enable any person so desiring voluntarily to assign'zis/her property tax rebate as herein described." Section 2. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. Section 4.
