HomeMy WebLinkAboutOrdinance-1984-0574INTRODUCED BY COUNCILMEMBER West ORDINANCE NO. 574 Series of 1984 TITLE: AN ORDINANCE APPROVING A LEASE/PURCHASE ARRANGEMENT BETWEEN THE CITY OF WHEAT RIDGE AND NCR FOR THE THREE. YEAR LEASE/PURCHASE OF COMPUTER EQUIPMENT TO BE UTILIZED BY THE CITY OF WHEAT RIDGE. WHEREAS, Section 12.9 of the Home Rule Charter of the City of Wheat Ridge requires that any lease/purchase of equipment by the City of Wheat Ridge be approved by ordinance adopted by the City Council of the City of Wheat Ridge; WHEREAS, the City Council of the City of Wheat Ridge has previously budgeted for, and approved the acquisition of, a computer system from NCR for a total cost of Seventy- Nine Thousand, Five Hundred Sixty Three Dollars ($79,563.00) for a three year period, of which sum Twenty-Two Thousand, Six Hundred Dollars 1`22,600.00) has been approved utilizing Revenue Sharing Funds; WHEREAS, the City is currently in possession of said equipment pursuant to a contract effective May 1, 1984, terminating April 30, 1987, which lease agreement has been approved by the City Attorney and signed by the Mayor contingent upon approval of this ordinance by this City Council. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, AS FOLLOWS: Section 1. The agreement between the City of Wheat Ridge and NCR, a copy of which is attached hereto as Exhibit A and expressly incorporated herein, is hereby ratified and adopted by this ordinance, and shall be enforced and enforceable pursuant to the terms thereof. Section 2. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. This ordinance shall take effect fifteen day after final publication. INTRODUCED, READ AND ADOPTED on first reading by a vote of 7 to 1 on the 14th day of May , 1984, ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for June ll , 1984, at 7:30 p.m. at Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
