ORDINANCE No. 575
Series of 1984
TITLE: AN ORDINANCE AMENDING SECTION 5-32 OF THE CODE OF
LAWS OF THE CITY OF WHEAT RIDGE PROVIDING FOR THE
ADOPTION BY REFERENCE OF THE AMERICAN NATIONAL
STANDARD SAFETY CODE FOR ELEVATORS, DUMBWAITERS,
ESCALATORS AND MOVING WALKS ANSI A17.1-1981 AND
THE ESTABLISHMENT OF PROCEDURES AND FEES FOR
INSPECTING AND TESTING SUCH CONVEYANCES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT
RIDGE, COLORADO THAT:
Section 1. Section 5-32 of the Code of Laws of the City of
Wheat Ridge is hereby amended by the addition of the following
paragraph (h):
Section 5-32(h). Section 5101, Chapter 51 of the Uniform
Building Code, 1982 Edition is hereby repealed and reenacted
as follows:
Section 5101(a) The purpose of this chapter is to safeguard life,
limb, property and public welfare by establishing minimum requirements
regulating the design, construction, alteration, operation and
maintenance of elevators, dumbwaiters, escalators, and moving walks
and by establishing procedures by which these requirements may be
enforced.
Section 5101(b) This chapter shall apply to new and existing
installations of elevators, dumbwaiters, escalators and moving walks;
requiring permits therefor;and providing for the inspection and
maintenance of such conveyances.
Section 5101(c) There is hereby adopted, by reference, American
National Standards Institute (ANSI) A 17.1 - 1981 - American National
Standard Safety Code for Elevators and Escalators, issued on October 22,
1981, published by the American Society of Mechanical Engineers. (ASME).
Three copies of said Code shall be available for public inspection in
the office of the City Clerk of the City of Wheat Ridge.
Section 5101(d)
Permits Required. It shall be unlawful to hereafter install any
new elevator, moving walk, escalator or dumbwaiter, to make major
alterations to any existing elevator, dumbwaiter, escalator or moving
walk without having first obtained a permit for such installation from
the building official. Permits shall not be required for maintenance
or minor alterations.
Section 5101(e)
1. Certificates of Inspection Required. It shall be unlawful to operate
any elevator, dumbwaiter, escalator or moving walk without a current
Certificate of Inspection issued by the building official. Such certifi-
cate shall be issued annually upon payment of prescribed fees and the
presentation of a valid inspection report indicating that the conveyance
is safe and that the inspection was made within the previous six months.
Certificates shall not be issued when the conveyance is posted as unsafe
pursuant to Section 5101(g)
EXCEPTION: Certificates of Inspection
shall not be required for conveyances
within a dwelling unit.
2. Application for a Certificate of Inspection shall be made by
the owner of an elevator, dumbwaiter, escalator or moving walk.
Applications shall be accompanied by an inspection report approved
by the building official. Fees as specified in this section shall
be paid at the time of application.
3. The fee for the Annual Certificate of Inspection for existing
installations shall be $45.00. This fee shall not apply to new
installations. New installation permit fees include charges for the
first year's annual inspection.
Section 5101(f) The owner shall be responsible for the safe operation
and maintenance of each elevator, dumbwaiter, escalator or moving walk
installation and shall cause periodic inspections, tests and maintenance
to be made on such conveyances as required in the ANSI Code. All costs
of such inspections and tests shall be paid by the owner.
Section 5101(g) When an inspection reveals an unsafe condition, the
inspector shall immediately file with the owner and the building official
a full and true report of such inspection and such unsafe condition. If
the building official finds that the unsafe condition endangers human life,
he shall cause to be placed on such elevator, escalator or moving walk in
a conspicuous place, a notice stating that such conveyance is unsafe. The
owner shall see to it that such notice of unsafe condition is legibly
maintained where placed by the building official. The building official
shall also issue an order in writing to the owner requiring the repairs or
alterations to be made to such conveyance which are necessary to render it
safe and may order the operation thereof discontinued until the repairs or
alterations are made or the unsafe conditions are removed. A posted notice
of unsafe conditions shall be removed only by the building official when he
is satisfied that the unsafe conditions have been corrected.
Section 2. Authority to enter into contract. The City of Wheat Ridge,
upon the advice of the Building Official, is hereby empowered to enter
into, and the Mayor is authorized to sign, an Agreement with other
municipalities empowering the Denver Regional Council of Governments
(DRCOG) to provide for inspections by an inspector selected by DRCOG
and to perform such other duties as may be prescribed in said Agreement
within the boundaries of the City of Wheat Ridge as though said
inspector was an employee of the City of Wheat Ridge.
Section 3. Violation and Penalties. It shall be unlawful for any
person, firm, or corporation to wreck, construct, enlarge, alter,
repair, move, improve, remove, convert or demolish, equip, use,
occupy or maintain any building or structure in the City, or cause
or permit the same to be done, contrary to or in violation of any of
the provisions of the Uniform Building Code. In addition to the
penalties set forth in Section 1-6 of this Code of Laws (which penalties
are applicable to violations of this Ordinance) the City is hereby
empowered to enforce the provisions hereof through injunctive or other
equitable relief.
Section 4. Severability. If any part or parts of this ordinance
are for any reason held to be invalid, such decision shall not affect
the validity of the remaining portions of this ordinance. The City
Council hereby declares that it would have passed this ordinance and
each part or parts thereof, irrespective of the fact that any one
part or parts be declared invalid.
Section 5. Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the police
power of the City of Wheat Ridge; that it is promulgated for the
health, safety, and welfare of the public, and that this ordinance is
necessary for the preservation of health and safety for the protection
of public convenience and welfare. The City Council further determines
that the ordinance bears a rational relation to these objectives.
Section 6. This ordinance shall take effect 30 days after final
publication.

to 0 on this 14th day of May , 1984;
ordered published in full in a newspaper of general circulation
in the City of Wheat Ridge and Public Hearing and consideration
on final passage set for June 25 , 1984 at
7:30 o'clock p.m., at Council Chambers, 7500 West 29th Avenue,
Wheat Ridge Colorado.
