Dennis, Elmer F. and Eileen I. Elliott, James Richard and Carol Lynn Johnson, Gerald E. and Pamela A. Falbo, Tadao and Fumiko Yamashita, Carlyn M. and Frank T. Sweeney, Hazel A. Tucker for approval of rezoning in Wheat Ridge, Colorado, Case No. WZ-84-8, and based upon recommendation for approval from the Wheat Ridge Planning Commission, and pursuant to findings made based on testimony and evidence presented at public hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby amended to exclude from the Residential-Three (R-3) district and to include in the Residential-One C (R-1C) district, the following described land: That part of the southwest quarter of Section 24, Township 3 South, Range 69 West, described as follows: Lots 7, 8, 9, 10, 11 of David Subdivision; and Lot 12, except the North 14 feet David Subdivision; and Lot 13 and the North 14 feet of Lot 12 David Subdivision; and Lots 14, 15, 16, 17 David Subdivision; and Lots 23 Castle Subdivision; and The North 30 feet of Lot 27 Castle Subdivision; r. - ORDINANCE NO. 579 PAGE 2 Beginning at a point which is 333.5 feet North of the Southwest corner of the SW 1/4, SE 1/4, SW 1/4 of Section 24, Township 3 South, Range 69 West, and running thence East a distance of 115 feet, thence South a distance of 65 feet, thence West a distance of 115 feet, thence North a distance of 65 feet to the point of beginning, all said property being in the County of Jefferson, City of Wheat Ridge, State of Colorado. Section 2. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason to be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 4. This ordinance shall take effect 15 days after final publication.
