TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
AGRICULTURAL-ONE (A-1), COMMERCIAL-ONE (C-1) AND COMMERCIAL-TWO (C-2)
TO PLANNED RESIDENTIAL DEVELOPMENT (PRD) AND APPROVAL OF AN OUTLINE
DEVELOPMENT PLAN ON LAND LOCATED AT 11680 W. 44TH AVENUE, CITY OF
WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon application by Warren Johnson for approval of rezoning in
Wheat Ridge, Colorado, Case No. WZ-84-1, and based upon recommendation for
approval from the Wheat Ridge Planning Commission, and pursuant to findings
made based on testimony and evidence presented at public hearing before the
4n:-gat Ridge City Council, Wheat Ridge maps are hereby amended to exclude from
the Agricultural-One (A-1), Commercial-One (C-1), and Commercial-Two (C-2)
Districts, and to include within the Planned Residential Development (PRD) Zone
District and approve an Outline Development Plan for the following described
land:
That portion of Block 12, Lee's Subdivision, a subdivision recorded in
the Official Records of Jefferson County, Colorado, described as follows:
Beginning at the East 1/4 corner of Section 20, Township 3 South, Range
69 West of the 6th P.M., said corner lying on the East line of said Block
12; thence SO 009'24"W, on an assumed bearing, along the East line of said
Block 12 a distance of 49.15 feet to the Southeast corner of the North
1/3 of said Block 12; thence S89030'22"W, along the South line of the
North 1/3 of said Block 12 a distance of 532.01 Eeet to the Southwest
corner of the East 1,/2 of the West 2/5 of the North 1/3 of said Block 12;
thence N0o07'26"W along the West line of the East 1/2 of the West 2V5 of
the North 1/3 of said Block 12 a distance of 48.31 feet; thence NO
12'33"W along the West line of the East 1/2 of the West 2/5 of the North
1/3 of said Block 12 a distance of 267.75 feet; thence N89 030'22"E a
distance of 137.93 feet to a point on the East line of the West 5.00 feet
of the East 1/2 of the West 4/5 of the North 1/3 of said Block 12; thence
NO°13'21"W along the East line of the West 5.00 feet of the East 1/2 of
the West 4/5 of the North 1/3 of said Block 12 a distance of 326.24 feet
to a point on the North line of said Block 12; thence N89o30'22"E along
the North line of said Block 12 a distance of 393.56 feet to the
Northeast corner of said Block 12; thence S0o15'4711E along the east line
of said Block 12 a distance of 593.14 feet to the Point of Beginning.
Section 2. Safety Clause. The City Council hereby finds, determines, and
declares that this ordinance is promulgated under the general police power of
the City of Wheat Ridge, that it is promulgated Eor the health, safety, and
welfare of the public, aril that this ordinance is necessary For the
preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circunstances shall for
any reason be adjudged by a court of competent jurisdiction invalid, such
judgment shall not affect, impair or invalidate the remainder of this ordinance
or its application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on
this 13th day of AUGUST 1984, ordered published in full in a
newspaper of general circulation in the City of Wheat Ridge and Public Hearing
ind consideration on final passage set for SEPTEMBER 10 1984, at 7:30
o'clock p.m., in the Council Chambers, 7500 West 29t17 Avenue, Wheat Ridge,
Colorado.
