HomeMy WebLinkAboutOrdinance-1984-0582INTRODUCED BY COUNCILMEMBER DAVIS ORDINANCE NO. 582 Series of 1984 TIT1,E: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM AGRICULTURAL-ONE (A-1) TO RESIDENTIAL-THREF (R-3) ON LAND LOCATED AT APPROXIMATELY 4208 MOORE STREET, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, SPATE OF COLORADO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Upon application by Phil Haas for approval of rezoning in Wheat Ridge, Colorado, Case No. WZ-84-13, and based upon recommendation for approval, with conditions, from the Wheat Ridge Planning Commission, and pursuant to findings made based on testimony and evidence presented at public hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby amended to exclude from the Agricultural-One (A-1) District and to include in the Residential-Three (R-3) District the following described land: A portion of Jaylarry Subdivision and a portion of the East 1/2 Section 21, Township 3 South, Range 69 West, of the Sixth Principal Meridian, County of Jefferson, State of Colorado, more particularly described as Eollows: Beginning at the northeast corner of Lot 15 of said subdivision; thence southerly along the east line of said subdivision 378.80 feet; thence N 90 degrees W. 55.00 feet to a point of curve; thence along a curve to the right having a radius of 125.00 feet, a central angle of 68 degrees 18' 33", an arc length of 149.03 feet; thence N 90 degrees W along the southerly line of Lot 6 of said subdivision and the easterly extension thereof, 200.45 feet to the west line of said subdivision; thence northerly along said west line, 305.00 feet to the southwest corner of Lot 4 of said subdivision; thence easterly along the south line of said Lot 4, 191.60 feet to the west right-of-way line of Moore Street; thence S 84 degrees 17' 22" E, 50.25 feet to the northwest corner of said Lot 15; thence easterly along the north line of said Lot 15, 138.00 feet to the point of beginning containing 2.82 acres more or less. Section 2. Conditions. 1. That the applicant provide for the dedication and improvements for West 42nd Avenue to connect Miller Street to West 42nd Avenue behind Newgate Apartments. Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 5. This ordinance shall take effect 15 days after final publication.
