HomeMy WebLinkAboutOrdinance-1984-0583INTRODUCED BY COUNCILMEMBER SNOW ORDINANCE NO. 583 Series of 1984 TITLE: AN ORDINANCE PROVIDING FOR If HE APPROVAL OF REZONING FROM RESTRICTED-COMMERCIAL (R-C) TO COMMERCIAL-ONE (C-1) ON LAND LOCATED AT 3805 WADSWORTH BOULEVARD, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO. BE IT ORDAINED RY THE CITY COUNCIL OF THE CITY OF wHEA'I RIDGE, COLORADO, THAT: Section 1. Upon application by Kunz Construction for Ken Westand of Westco Midas Muffler for approval of rezoning in Wheat ridge, Colorado Case No. WZ-84-16, and based upon recommendation for approval, with conditions, from the Wheat Ridge Planning Commission, and pursuant to findings made based on testimony and evidence presented at public hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby amended to exclude fran the Restricted-Commercial (R-C) District and to include in the Commercial-One (C-1) District, the following describe9 ]-Ind: Beginning at a point 30 feet north of the southeast corner of SW 1/4 of Section 23, Township 3 South, Range 69 West, said point being the North line of West 38th Avenue; thence north along the east line of said SW 1/4 of said Section 23, 125 feet; thence at right angles west parallel with the north line of West 38th Avenue, 195.3 feet; thence south parallel with the east line of the SW 1/4 of Section 23, 125 feet to the north line of West 38th Avenue; thence east along the north line of West 38th Avenue 195.3 feet, to place of beginning, except the east approximately 30 feet thereof now being used for Wadsworth Avenue, less (1) a 1,250 square f,)()t tract conveyed to the Department of Highways, State of Colorado. Section 2. Conditions. The attached site plan, marked Exhibit A, incoraorlted herein as a part of this ordinance is a condition to site development as it relates to street improvements and dedication, building location and size, parking, curb cuts, and landscaping. Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of ',cheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. Severn`) it . If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainoler- of this ordinance or its application to other persons or circumstances. Section 5. This ordinance shall take effect 15 days after final publication.
