WV-84-2) WITHIN THE CITY OF WHEAT RIDGE, COLORADO, AS MORE FULLY DESCRIBED HEREIN. WHEREAS, a certain street known as Moore Street was dedicated to the public / with a full cul-de-sac at the end of said street at approximately 4200 Moore Street; and WHEREAS, that part of said Moore Street which is a cul-de-sac as described herein is no longer necessary for use by the public; and WHEREAS, said part of said street is within the limits of the City of Wheat Ridge, Colorado; and WHEREAS, no land would, by a vacation of a part of said street, be left without an established public road connecting it with another established public road; and WHEREAS, West 42nd Avenue is to be dedicated and constructed so as to connect Moore Street to another street and therefore a cul-de-sac is no longer needed; and WHEREAS, the Wheat Ridge Planning Commission has approved the vacation of said part of said street; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. The following part of Moore Street, a dedicated street in the City of Wheat Ridge, County of Jefferson, Colorado, is hereby vacated, to wit: LEGAL DESCRIPTION - RIGHT-OF-WAY, LOT 13: A portion of Jaylarry Subdivision located in the east 112 of Section 21, Township 3 South, Range 69 West, of the 6th Principal Meridian, County of Jefferson, State of Colorado, more particularly described as follows: Beginning at the northwest corner of Lot 13 of said subdivision; thence S 0° E along the west line of said lot 53.80 feet to a point of curve; thence alon a curve to the left having a radius of 75.00 feet, a central angle of 14 51'33", an are length of 19.45 feet to a point on a curve whose radius bears N3704015811W, 45.00 feet; thence along said curve to the left having a central angle of 10803410611, an arc length of 85.27 feet to the Point of Beginning containing 1020 square feet or 0.023 acres, more or less. LEGAL DESCRIPTION - RIGHT-OF-WAY, LOT 6: A portion of the Jaylarry Subdivision located in the east 112 of Section 21, Township 3 South, Range 69 West, of the 6th Principal Meridian, County of Jefferson, State of Colorado, more particularly described as follows: Beginning at the northeast corner of Lot 6 of said subdivision; thence SO ° E along the east line of said lot 53.80 feet to a point of curve; thence along a curve to the left having a radius of 125.00 feet, a central angle of 10°16'38", an arc length of 22.42 feet to a point on a curve whose radius bears '1430°43'47" E, 45.00 feet; thence along said curve to the right having a central angle of 115°31'17", an arc length of 90.73 feet to the Point of Beginning containing 1080 square feet, more or less. Section 2. The provisions of this ordinance are necessary to the preservation of the public health and safety of the citizens of the City of Wheat Ridge, Colorado, because said property is not needed for public use. Upon the vacation accomplished hereby, title to the property vacated shall revert, by operation of Colorado Law CRS 43-2-302, to Phillip Haas as the sole abutting landowner. Section 4. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and c;z welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 5. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 6. This ordinance shall take effect 15 days after final publication. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on this 13th day of AUGUST , 1984, ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for SEPTEMBER 10 , 1984, at 7:30 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
