TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM PLANNED
INDUSTRIAL DEVELOPMENT AND AGRICULTURAL-ONE TO PLANNED INDUSTRIAL
DEVELOPMENT AND APPROVAL OF AN AMENDMENT TO A PLANNED INDUSTRIAL
DEVELOPMENT FINAL DEVELOPMENT PLAN ON LAND LOCATED AT 10501 WEST 48TH
AVENUE, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon application by Robert Entrup for approval of a rezoning and
an amendment to a Final Development Plan in Wheat Ridge, Colorado, Case No.
WZ-84-17 and based upon recommendation for approval from the Wheat Ridge
Planning Commission, and pursuant to findings made based on testimony and
evidence presented at public hearing before the Wheat Ridge City Council,
Wheat Ridge maps are hereby amended to exclude from the Planned Industrial
Development and Agricultural-One Districts and to include in the Planned
Industrial Development District, and for approval of an Amended Final
Development Plan, the following described land:
A part of the SW 1/4, SE 1/4 of Section 16, Township 3 South, Range 69
West of the 6th P.M. described as: Beginning at a point which is
789.00 feet east of the southwest corner of the SE 1/4 of Section
16, Township 3 South, Range 69 West and 303.5 feet north parallel to
the east line of the SW 1/4, SE 1/4 of Section 16, Township 3 South,
Range 69 West; thence, continuing northerly along a line parallel to
the east line of the SW 1/4, SE 1/4 a distance of 181.50 feet; thence,
East parallel to the south line of the SW 1/4, SE 1/4 a distance of
299.70 feet; thence south parallel to the east line of the SW 1/4, SE
1/4 a distance of 75.75 feet; thence West parallel to the south line
of the SW 1/4, SE 1/4 a distance of 30.00 feet; thence south parallel
to the east line of the SW 1/4, SE 1/4 a distance of 75.75 feet;
thence east a distance of 271.30 feet to a point on the east line of
the SW 1/4, SE 1/4; thence south 30.00 feet along the east line of the
SW 1/4, SE 1/4; thence west parallel to the south line of the SW 1/4,
SE 1/4 a distance of 541.00 feet to the Point of Beginning except the
east 30 feet for roadway purposes, containing 1.363 acres, more or
less, County of Jefferson, State of Colorado.
Section 2. Safety Clause. The City Council hereby finds, determines, and
declares that this ordinance is promulgated under the general police power of
the City of Wheat Ridge, that it is promulgated for the health, safety, and
welfare of the public, and that this ordinance is necessary for the
preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall for
any reason be adjudged by a court of competent jurisdiction invalid, such
judgment shall not affect, impair or invalidate the remainder of this ordinance
or its application to other persons or circumstances.
Section 4. This ordinance shall take effect I day after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on
this 19th day of November , 1984, ordered published in full in a
newspaper of general circulation in the City of Wheat Ridge and Public Hearing
and consideration on final passage set for December 17 , 1984, at 7:30
o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge,
Colorado.
