TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
RESIDENTIAL-THREE (R-3) TO RESTRICTED-COMMERCIAL (R-C) ON LAND LOCATED
AT 3700 WADSWORTH BLVD., CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON,
STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon application by Nina Gunderson for approval of rezoning in
Wheat Ridge, Colorado, Case No. WZ-84-27 and based upon recommendation for
approval, with conditions, from the Wheat Ridge Planning Commission, and
pursuant to findings made based on testimony and evidence presented at public
hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby
amended to exclude from the Residential-Three (R-3) District and to include in
the Restricted-Commercial (R-C) District, the following described land:
I. That part of the NW 1/4 of the NE 1/4 of Section 26, Township 3
South, Range 69 West of the 6th P.M., described as follows: Beginning
at a point which is 30 feet east and 302.2 feet south of the northwest
corner of the NE 1/4 of Section 26, Township 3 South, Range 69 West,
marked by a stone on the east line of Wadsworth Blvd.; thence east 100
feet to the True Point of Beginning; thence east 135.5 feet to a point
(on the line of property of R.T. Davis); thence south 110 feet to a
point (also on the line of property of R.T. Davis); thence west 135.5
feet to a point; thence north 110 feet to a Point of Beginning, County
of Jefferson, State of Colorado.
II. Commencing at a point which is 30 feet east and 302.2 feet south
of the northwest corner of the NE 1/4 of Section 26, Township 3 South,
Range 69 West, marked by a stone in the intersection of West 38th
Avenue and Wadsworth Blvd., said point being on the east line of
Wadsworth Blvd.; thence east 100 feet, parallel with the south line of
West 38th Avenue; thence south 110 feet, parallel with the east line
of Wadsworth Blvd., thence west 100 feet; thence 110 feet north along
the east line of Wadsworth Blvd., to the Point of Beginning, EXCEPTING
therefrom the West 15 feet thereof, in use as Wadsworth Blvd., County
of Jefferson, State of Colorado.
Section 2. Conditions.
1. Curb, gutter and sidewalk and an accel/decel lane be installed at the time
of development.
2. This parcel be encouraged to share access with the property to the south
thus reducing the number of curb cuts on Wadsworth Blvd.
Section 3. Safety Clause. The City Council hereby finds, determines, and
declares that this ordinance is promulgated under the general police power of
the City of Wheat Ridge, that it is promulgated for the health, safety, and
welfare of the public, and that this ordinance is necessary for the
preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be attained.
Section 4. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall for
any reason be adjudged by a court of competent jurisdiction invalid, such
judgment shall not affect, impair or invalidate the remainder of this ordinance
or its application to other persons or circumstances.
Section 5. This ordinance shall take effect 1 days after final
publication.
