TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
COMMERCIAL-TWO AND AGRICULTURAL-ONE TO PUBLIC FACILITIES-ONE ON LAND
LOCATED AT 11200 WEST 45TH AVENUE, CITY OF WHEAT RIDGE, COUNTY OF
JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section I. Upon application by City of Wheat Ridge for approval of rezoning
in Wheat Ridge, Colorado, Case No. WZ-84-33, and pursuant to findings made
based on testimony and evidence presented at public hearing before the Wheat
Ridge City Council, Wheat Ridge maps are hereby amended to exclude from the
Commercial-Two and Agricultural-One Districts and to include in the Public
Facilities-One District, the following described land:
A tract of land located in the northwest one-quarter of Section 21,
Township 3 South, Range 69 West of the 6th P.M., City of Wheat Ridge,
Jefferson County, Colorado, described as follows: Beginning at the
southwest corner of the east one-half of the northwest one-quarter of
said Section 21; thence N0009119"W, on an assumed bearing, along the
west line of the east one-half of the northwest one-quarter of said
Section 21 a distance of 1049.09 feet to the True Point of Beginning;
thence N896511021?E, parallel to the south line of the east one-half of
the northwest one-quarter of said Section 21, a distance of 255.00
feet; thence NO 009'19"W, parallel to the west line of the east
one-half of said Section 21, a distance of 310.00 feet to a point
710.00 feet north of the north line of the County Road known as the
North Golden and Denver Road or West 44th Avenue; thence westerly
parallel to the north line of said County Road a distance of 255.00
feet to a point on the west line of the east half of the northwest
quarter of said Section 21; thence S000911911E along the west line of
the east one-half of the northwest one-quarter of said Section 21, a
distance of 37.95 feet to the northeast corner of the northeast
one-quarter of the southwest one-quarter of the northwest one-quarter
of said Section 21; thence S890 46' 39"W along the north line of said
northeast one-quarter a distance of 220.79 feet to a point on the west
line of the east two-thirds of the northeast one-quarter of the
southwest one-quarter of the northwest one-quarter of said Section 21;
thence S0010'20"E along the west line of said east two-thirds, a
distance of 250.00 feet; thence N89046'39"E along the south line of
the north 250.00 feet of said east two-thirds, a distance of 220.72
feet to a point on the east line of the northeast one-quarter of the
southwest one-quarter of the northwest one-quarter of said Section 21;
thence S000911911E along the east line of the northeast one-quarter of
the southwest one-quarter of the northwest one-quarter of said Section
21, a distance of 22.05 feet to the TRUE POINT OF BEGINNING,
containing 3.082 acres, more or less.
Section 2. Safety Clause. The City Council hereby finds, determines, and
declares that this ordinance is promulgated under the general police power of
the City of Wheat Ridge, that it is promulgated for the health, safety, and
welfare of the public, and that this ordinance is necessary for the
preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part of
this ordinance or the application thereof to any person or circumstances shall
for any reason be adjudged by a court of competent jurisdiction invalid, such
judgment shall not affect, impair or invalidate the remainder of this
ordinance or its application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final
publication.

and consideration on final passage set for January 14 , 1985, at 7:30
o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge,
Colorado.
