TITLE: AN ORDINANCE PROVIDING FOR CORRECTION OF THE LEGAL DESCRIPTION
INCLUDED IN THE CITY COUNCIL MOTION OF DECEMBER 22, 1975 FOR REZONING
CASE NO. WZ-75-19 AND CORRECTION OF THE ZONING MAP, EFFECTIVELY
REZONING PROPERTY FROM COMMERCIAL-ONE AND RESIDENTIAL-TWO TO
COMMERCIAL-ONE AND RESIDENTIAL-TWO LAND GENERALLY AT 6089, 6287, and
6289 WEST 48TH PLACE AND 6285 WEST 48TEI AVENUE, CITY OF WHEAT RIDGE,
COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COU14CIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon application by the City of Wheat Ridge for approval of
rezoning in Wheat Ridge, Colorado, Case No. WZD-84-35 and based upon
recommendation for approval from the Wheat Ridge Planning Commission, and
pursuant to findings made based on testimony and evidence presented at public
hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby
amended to exclude from the Residential-Two and Commercial-One Districts and
to include in the Commercial-One Zone District, the following described land:
That part of Block 19, Berkeley Heights, Second Filing, in the south
half of the southwest quarter of Section 13, Township 3 South, Range
69 West of the 6th Principal Meridian, in Jefferson County, Colorado,
described at beginning at a point 1332.35 feet west and 870 feet north
of the south quarter corner of Section 13, Township 3 South, Range 69
West, thence S000 37'05"W 109.0 feet to the True Point of Beginning;
thence S0000810511W 200.0 feet; thence S47010'20"E 115.0 feet; thence
S30 °18'20"E 155.7 feet; thence N43 55'40"E 318.97 feet; thence NOOO
0810511E 181.0 feet; thence N890 43'14"W 384.15 feet to the True Point
of Beginning.
The following described real property, which is subject to a City Council
rezoning by motion of December 22, 1975, in Case No. WZ-75-19 is hereby
excluded from the Commercial-One District and included in the Residential-Two
District:
Beginning at a point which is located at a pipe set at the intersector
of the west line of Block 14, Berkeley Heights Subdivision, Second
Filing and the southeasterly line of Block 19, Berkeley Heights
Subdivision, Second Filing said point also described as the northwest
corner of Lot 34 Block 14, Berkeley Heights Subdivision, Second
Filing; thence S43b5514011W a distance of 318.97 feet to a steel pin;
thence N3001812011W a distance of 115.9 feet to a domed spike; thence
N47010'W a distance of 115.0 feet to a pipe set on land line; thence
N000081E a distance of 200 feet to a point; thence east parallel to
the south line of the southwest quarter of Section 13, Township 3
South, Range 69 West, S89043'3011E a distance of 385 feet; thence south
parallel to the westernmost property line for the property as
described on Page 445, Book 2216, County of Jefferson, State of
Colorado, a distance of 181 feet, more or less, to the Point of
Beginning.
EXCEPT any real property included within the following:
That part of Block 19, Berkeley Heights, Second Filing, in the south

Section 2. Safety Clause. The City Council hereby finds, determines, and
declares that this ordinance is promulgated under the general police power of
the City of Wheat Ridge, that it is promulgated for the health, safety, and
welfare of the public, and that this ordinance is necessary for the
preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall for
any reason be adjudged by a court of competent jurisdiction invalid, such
judgment shall not affect, impair or invalidate the remainder of this
ordinance or its application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on
this 14th day of January , 1985, ordered published in full in a
newspaper of general circulation in the City of Wheat Ridge and Public Hearing
and consideration on final passage set for February 11 1985, at 7:30
o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge,
Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a vote of
7 to 1 , this 11th day of February , 1985.
