HomeMy WebLinkAboutOrdinance-1985-0610INTRODUCED BY COUNCILMEMBER Keller _ ORDINANCE NO. 610 Series of 1985 TITLE: AN ORDINANCE AMENDING SECTION 12-2 OF THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE BY REPEALING AND RENACTING SECTION 4-1, BASIC RULE, OF THE MODEL TRAFFIC CODE FOR COLORADO MUNICIPALITIES TO PROVIDE THAT ALL POSTED SPEED LIMITS ARE MAXIMUM LAWFUL SPEED LIMITS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, AS FOLLOWS: Section 1. Section 12-2 of the Code of Laws of the City of Wheat Ridge is hereby amended by the addition of the following provisions: "Section 4-1(a), Basic Rule, of the Model Traffic Code is hereby repealed and renacted as follows: 4-1(a). No person shall drive a vehicle on a street or highway within this municipality at a speed greater than is authorized in this Section 4.1, and in no event greater than 55 miles per hour." Section 2. Section 12-2 of the Code of Laws of the City of Wheat Ridge is hereby amended by the addition of the following provision: "Section 4-1(c), Basic Rule, of the Model Traffic Code is hereby repealed and renacted as follows: (c). The speed limits specified in Subsection 4- 1(b) hereof shall be considered maximum lawful speed limits and not prima facie speed limits." Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 5. This ordinance shall take effect 15 days after final publication.
