HomeMy WebLinkAboutOrdinance-1985-0620INTRODUCED BY COUNCILMEMBER NJiIde ORDINANCE NO. 620 Series of 1985 TITLE: AN ORDINANCE INITIATING AN AMENDMENT TO THE HOME RULE CHARTER OF THE CITY OF WHEAT RIDGE, AMENDING SECTION 4.3(B), TERMS OF OFFICE, OF SAID CHARTER TO PROVIDE FOR STAGGERED FOUR YEAR TERMS OF OFFICE FOR MEMBERS OF CITY COUNCIL. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. The Charter Amendment proposed in this Ordinance shall be submitted to a vote of the Registered Electors at the Regular Municipal Election of November 5, 1985 and if adopted, shall take effect immediately. Section 2. If adopted at the regular municipal election of November 5, 1985, Section 4-3(b) of the Wheat Ridge Home Rule Charter shall be amended by repealing and reenacting said Section 4.3(b) as follows: At the general municipal election of November 5, 1985, the candidate from each Council District receiving the largest number of votes shall be elected for a four (4) year term, and the candidate receiving the second largest number of votes shall be elected for a two (2) year term. On the first Tuesday after the first Monday in November of 1987, and thereafter at the general municipal election, one Council member from each Council District shall be elected for a four (4) year term. Section 3. The ballot title to be submitted to the registered electors of the City on November 5, 1985 shall read as follows: Shall Section 4-3(b) of the Wheat Ridge Home Rule Charter be amended to provide for four (4) year terms of office for Council members, commencing with the election of November 5, 1985 when one Council member from each district shall be elected for a four (4) year term and the other Council member from each district shall be elected for a two (2) year term, and providing further that commencing with the general municipal election of the first Tuesday after the first Monday of November of 1987, and thereafter, all Council members would be elected for terms of four years. Section 4. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 5. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 6. This ordinance shall take effect 15 daysafter final publication.
